Notes on proper usage and accuracy
[edit]Brands are ubiquitous in society. Many folks do not realize that when they talk about Things in the physical world, they often are speaking of Brands and Trademarks. Both Brands and Trademarks are temporal concepts where ownership can be given, transferred, or even bartered over time. Something many of us sometimes forget (unless you are a Trademark lawyer :-) ) To be clear, Trademark and Brand laws in countries carry significant weight and so proper use of brand (P1716) and care should be taken to adequately portray factual statements of ownership, dates, and entities involved.
For example:
"msn" is one of the brands of Microsoft, and carries with it a logo, textual representation, and graphic representation, and a significant amount of legal documentation for proving trademark and branding rights currently held by Microsoft (Q2283). In Wikidata, we have the collection of sites (a portal) known as "msn" with MSN (Q192845), and this entity is a different type (web portal (Q186165)) and serves a different purpose, and it itself is represented by unique branding. There can be another entity to represent the brand of "msn" as well, where "msn" is an instance of a brand (Q431289) , which could have links to various Trademarks, Logos, and Legal Documentation over time as part of Microsoft (Q2283) intellectual property (Q131257). (just an example. Feel free to add any structured data to make this example a "real" example, if you have the time and patience.) Anyways, let's move on to ownership.
Another point of accuracy is in the ownership of a brand that can change over time. Something that might not be evident at first especially if you don't have access to trademark databases and are merely using web searches for research...many companies setup exclusive branding companies that hold and retain the rights of their intellectual property, where their branding company is not the same as (but sometimes part of) their parent company. A company might acquire another company, it's brands, and then later sell the company, but keep and retain the rights for some time or forever the brands themselves! Yes, confusing sometimes, right? Mistakes can sometimes happen especially when trying to find the real (legal) owners of a particular brand at any point in time. In some countries, the laws can make things easier, and sometimes harder, depending on where you live in our world. For example, in some countries, in order to get and provide accurate information for Wikidata statements around branding, you would have to make a trip to the courthouse and request access to records, since it's sometimes locked away from regular public access.
