【🔎Implications of the Development or Use of AI on Personal Data Privacy – PCPD Completed Compliance Checks on 28 Organisations👨🏻💻】 🤖To understand the implications of the development and use of AI on personal data privacy in Hong Kong🔐, the PCPD carried out compliance checks🔎 on 28 local organisations from August 2023 to February 2024 to understand their practices in relation to the collection, use and processing of personal data 📝in the development or use of AI, as well as the AI governance structure of the relevant organisations👨🏻💼. The exercise covered various sectors, including telecommunications🤳🏻, finance and insurance💰, beauty services💄, retail🛍, transportation🚗 and education sectors📚, and government departments🏢. The PCPD has found no contravention of the PDPO✅ during the compliance check process🔎. Executive Summary of the OECD Report on AI, Data Governance, and Privacy Recent advances in artificial intelligence (AI), particularly generative AI, present both opportunities and risks for data protection and privacy. AI, as a versatile technology, is increasingly embedded in products, sectors, and business models worldwide. The development of generative AI has been driven by the availability and utilization of vast amounts of training data globally. This global distribution of data and AI lifecycle actors highlights the need for synchronized, clear guidelines and cooperative efforts to address AI's impact on privacy. AI and privacy policy communities often work independently, leading to varied approaches across jurisdictions and legal systems. The practice of scraping personal data for training generative AI raises significant privacy issues, attracting regulatory attention. The lack of cooperation between AI and privacy communities can result in misunderstandings and conflicting or duplicative regulatory requirements, complicating compliance and enforcement. Collaborative efforts could enhance policy responses and improve alignment and consistency between AI policies and data protection frameworks. The AI community is characterized by dynamic networks focused on innovation, while the privacy community is established with a focus on safeguarding privacy within sophisticated regulatory frameworks. Despite these differences, synergies exist, and cooperation is essential for addressing AI and privacy challenges effectively. Various national and regional initiatives address AI and privacy, including guidance from privacy regulators on applying privacy laws to AI and enforcement actions specifically related to generative AI. Further coordination is needed as more countries introduce AI-specific laws. The OECD plays a crucial role in promoting standardization of key terminologies and fostering international cooperation in AI and privacy.
