【🔎Implications of the Development or Use of AI on Personal Data Privacy – PCPD Completed Compliance Checks on 28 Organisations👨🏻💻】 🤖To understand the implications of the development and use of AI on personal data privacy in Hong Kong🔐, the PCPD carried out compliance checks🔎 on 28 local organisations from August 2023 to February 2024 to understand their practices in relation to the collection, use and processing of personal data 📝in the development or use of AI, as well as the AI governance structure of the relevant organisations👨🏻💼. The exercise covered various sectors, including telecommunications🤳🏻, finance and insurance💰, beauty services💄, retail🛍, transportation🚗 and education sectors📚, and government departments🏢. The PCPD has found no contravention of the PDPO✅ during the compliance check process🔎. Head of Telecommunications, Media & Technology Practice Group, Chong Kin Lim 林宗勤, was quoted in an article by Global Data Review dated 7 February 2024, discussing the ASEAN Guide on AI Governance and Ethics, which was recently released by the Association of Southeast Asian Nations (ASEAN). Chong Kin was quoted as saying that an “excellent feature” of the Guide is that it specifies whether it is the developer or deployer of the AI system who must take the recommended action. He also observed that “[t]he Guide is very much in line with the international community on the principles of AI governance (such as the OECD AI principles) and on identifying the risks of AI (e.g. bias, cybersecurity concerns, lack of explainability, privacy) that must be addressed”, and that “It is also aligned in that a risk-based approach is key, where the level of measures taken in part depends on the impact of the AI system on its users.”. He shared that “AI regulation in the region is unlikely to follow in the short term”, citing the ongoing debate over copyright and AI, along with the need to establish a common testing framework as issues to be settled first. You may have seen the EU AI Act was approved yesterday. Having just scanned the act again, one thing stood out (there were a lot of things, by the way)! It's not that education and vocational training are in the 'high risk' category. It was in the segment "Employment, workers management and access to self-employment," also classed as high risk. It states "AI intended to be used for making decisions on the promotion and termination of work-related contractual relationships, for task allocation and for monitoring and evaluating the performance and behaviour of persons in such relationships." .....monitoring and evaluation of performance and behaviours.... The act also highlights that "this may impact their rights to data protection and privacy". This needs a lot more exploration and definition of what this truly means, as well as the rest of the act. Key takeaways about AI governance from the IAPP - International Association of Privacy Professionals-EY Privacy Governance Report 2023: There is a global effort to implement AI governance in companies, but we are still not there. Many frameworks need to be implemented, but this can be challenging, especially when keeping up with the latest developments and building governance policies internally. To implement these: 🔻 AI governance teams 🔻AI ethics policies 🔻AI privacy risk assessments Companies must have: 🔺 Enough skilled personnel 🔺Clear understanding of AI regulations and compliance requirements (at this point) 🔺Understanding of the complexity of the AI systems they are using As the report states, the majority of companies are moving in the direction of implementing enough governance measures to tackle the incoming AI compliance tsunami. However, the report does not delve into the quality of these governance functions, so this question remains unanswered... Companies can have enough governance teams and policies, but the real challenge is keeping up with the rapid pace of change in the AI landscape. This is no longer a daily challenge, but an hourly one. There will be disruptive changes in the business scene, and it could be too late for companies that have not yet started implementing AI governance frameworks. Start as soon as possible. I have been reflecting on AI colonialism and how nation states can counter it. GDPR requires all data processors to declare how they will use the data shared and it also requires data processors to be able to explain how they reached each decision. Based on the privacy policy shared, is it possible for national governments to control the flow of national data towards training of AI in external countries? Based on the transparency of decision processes, is it possible for national governments to control the usage of AI from other countries to process the data in own country? If both of these are possible (and I am certain that it is possible with some effort), then nation states can prevent being colonised by AIs from other nation states. But there are costs and benefits of such prevention. It is possible to throw out the baby with the bath water. Not using the best AI available globally may not be in the best interest of national competitiveness. I am sure there are other matters arising from this. I will continue to reflect on this.

With the new #EUAIAct coming into action and being on my mind, my few cents on it: This Act is set to revolutionize data privacy in the AI landscape. This brings stricter regulations around high-risk AI systems. And would the same data privacy requirements apply? if yes, is it feasible? Well, their will be no relaxation of data protection principles of GDPR like transparency, limiting practices and safeguarding of individual's personal data and fundamental rights. In fact, it would become even more important to comply with data privacy and security practices especially when it comes to high-risk AI systems. Rules will be less stricter for low-risk AI systems. This actually marks a significant step towards a more ethical and privacy-centric approach to AI development in the EU and beyond. #AI #DataPrivacy #EURegulation #AIethics
