  • 14:2714:27, 3 February 2022 diff hist +88 Claim of Right 1689The widely published error that the Claim of Right was passed by the Scottish Parliament is an important one. In the absence of a legitimate monarch, James VII and II having fled, no parliament could meet. In such circumstances the Convention of the Estates could function in its place. It did so in 1689 and passed the Claim of Right with a List of Grievances setting out the "fundamental" constitution of Scotland and the penalty for its violation, forfeiture of legitimacy.
