Indian Election Symbols, Party Symbols and Logos

[edit]

These images are not covered by COM:FOP#India. These are logos and symbols of Institutions which are under copyright in India. These are designed by the political parties themselves or by the election commission of India. Either case they are definitely not in public domain and only fair use can be applied to them.

Please see these discussions too:

There has been conflict in previous resolutions with files of this nature. File:INC-flag.svg was kept, but File:BJP-flag.svg was deleted. I have no idea why.

Jayarathina -- could you tell me which particular file(s) I uploaded new versions of, so that I can evaluate the status of the file(s) that I'm responsible for individually? Thanks... AnonMoos (talk) 13:09, 18 October 2014 (UTC)[reply]
I think this request is not helpful. No one has complained on the use of these images and several of them are not simple copies but original creations of the uploader. --Furfur (talk) 14:03, 18 October 2014 (UTC)[reply]
"No one has complained on the use of these images" violates our fundamental principles, see COM:PRP. If, in fact, any of them are original creations of the uploader and not derivative works, then they are out of scope as personal art. .     Jim . . . . Furfur, "several of them are not simple copies but original creations of the uploader" I am sorry, I might have missed something, all of these are logo's of organization. These are derivative works of copyrighted materials. --Jayarathina (talk) 14:46, 18 October 2014 (UTC)[reply]
AnonMoos, I pinged every one who had to do something (uploading or modifying) with the listed images. You have modified File:Pirate party india logo.svg, hence I messaged you. Thanks. --Jayarathina (talk) 14:46, 18 October 2014 (UTC)[reply]
  • I'll comment on the Aam Aadmi Party logos, which were the only ones with which I was involved. These are simple letters and a simple geometric shape, and so are covered under not meeting the threshold of originality, FOP has nothing to do with them. I therefore advocate to  Keep these. Two previous DRs (cited above) have borne this out. Most of the rest do look sufficiently artistic to pass TOO, and so may need to be deleted. Seraphimblade (talk) 17:32, 18 October 2014 (UTC)[reply]
  • It's good this discussion happens because we need to be coherant about what stays here and what should be deleted. Most of the logos or flag are derived from an election symbol. The election symbols are designed by the Election Commission of India and chosen by the parties: what does the Indian law say about these symbols? --Superbenjamin (talk) 07:48, 19 October 2014 (UTC)[reply]
Keep Many of these are too simple for copyright. All files should be kept and those which are more suspect should be renominated on an individual basis. Fry1989 eh? 17:52, 22 October 2014 (UTC)[reply]
  •  Request for clarification
So from commons POV, are these sufficient enough to claim these are in public domain? Someone with knowledge in this area has to clarify this. --Jayarathina (talk) 05:21, 23 October 2014 (UTC)[reply]

Procedural close. There are too many issues here to deal with a DR this large. I suggest opening a DR with a few of the files, picking only those that are obviously well over the ToO and seeing what the community thinks. Jayarathina, please remember that copyright notice is not required anywhere now, so its absence is irrelevant. The only place notice was required was in the USA and only then until 1989. .     Jim . . . . (Jameslwoodward) (talk to me) 13:11, 25 October 2014 (UTC)[reply]
