Images of people uploaded by Aquila Leite

[edit]

The following files do not seem to be the work of the uploader, they look like scans from a book, and thus suspected from copyright violation.

Now I can see that File:2º Prefeito de Araripina - Francisco da Rosa Muniz.jpg and File:1º Prefeito de Araripina - Joaquim José Modesto.jpg were uploaded from Flickr, where the works were licensed as cc-by-2.0. However, I have strong doubts that the uploader to Flickr had the right to license the photos in that way. --Jan Kameníček (talk) 14:49, 26 December 2024 (UTC)[reply]
These are public images provided by the city hall of the town I live in, images free for use. If it's within your capacity, use Google Lens and you'll see that there are several reproductions of the same images on websites and social media.
But it was necessary for me, personally, to go to the municipal government headquarters to take photos, then upload them to Flickr, so I could upload them here on Commons, and even so, they are deleting them!

@Jan.Kamenicek, If your doubts are regarding the format of the photo on Commons compared to Flickr, well, the photos on Flickr are unedited photos, due to the difficulty in finding a good position to photograph.
However, they are all the same photos, with the difference that for Commons I adjusted them to standardize the list where they are used. Especially because it goes against Wikipedia's formatting standards to have "crooked" photos that misalign the page. But the photos are the same.
If necessary, I'll go back to the city hall and take selfies to see if you believe I took the photos!

What is necessary to upload a photograph of a public gallery in the city where I reside, where I went to the city hall, received clear authorization to photograph the gallery, and use it for whatever purpose I am interested in?

@Jan.Kamenicek, Como deseja que eu fotografe os prefeitos falecidos da minha cidade?
File:Photo 2024-12-30-Aquila.jpg

I nominated these photos because they were tagged as being your work and released under {{self|cc-by-4.0}}, which was apparently not true. I am not an expert in Brazilian law, but it is quite possible that some of them are in public domain under {{PD-Brazil-Photo}}. So, if you think that some of the nominated photos fulfill all the requirements of this licence, please note which. --Jan Kameníček (talk) 13:33, 30 December 2024 (UTC)[reply]
@Jan.Kamenicek, Here in Brazil, for the first time last year (2023), we had stricter legislation regarding this issue. But it is strict for politicians in office, they were "prohibited" from using their own images during their term. However, this legislation maintained the autonomy of municipalities to determine their own laws and use of images. However, this legislation maintained the autonomy of municipalities to determine their own laws and use of images..

Projeto de Lei (PL) nº 1.731, de 2023
In my city, the previous legislation was maintained, only adapting the use of the position for personal gain!
See the Municipal Law:

@Jan.Kamenicek, The municipal law establishes that everything available for public access cannot be denied access or use for any purpose:
Art. 4 The Citizen Information Service - SIC is hereby established in the Municipality.
of Araripina guaranteeing the right to access information, which will be provided
through procedures, objectives, and agile methods, in a transparent, clear manner, and in language
easy to understand.
Sole paragraph - The Municipal General Comptroller is responsible for guiding and
monitor the provision of SIC, as well as, inform citizens about the procedures for
access to information.
Art. 5 The Information Evaluation Commission - CAI will be created through
ordinance, with the aim of clarifying doubts and qualifying information or documents
like stealthy ones.

There is no legislation in Araripina that regulates copyright for what is not explicitly stated in the law.

First we need to find some suitable license tag. Maybe some of those listed at Commons:Copyright tags/Country-specific tags#Brazil could be applied. --Jan Kameníček (talk) 18:23, 30 December 2024 (UTC)[reply]
