Uploader is not the original author. According to the article it is being used in, the photograph was taken in 1928. The picture is credited to a El Comercio here – that should be the newspaper it was scanned from, probably en:El Comercio (Peru). Now we would need someone with access to the old volumes of that newspaper: We need to know if there was the name of the photographer mentioned below the image. It has been almost a decade since this was discussed but this is no longer in use and COM:HOST applies. In the prior discussion, the fact that it was humor about Wikipedia (and now in Category:Parodies of Wikipedia) doesn't change the fact that humor about Wikipedia is itself sufficient to make things used here. Anyone can make this fun on their own website and I still think it's harassment.  Keep definitely. Invalid request. This is a cultural flag. The policy of Commons is definitely not to accept only official flags. In addition these images do not violate any copyright policy, and there open licence is valid here. May be it's a creative image, but all photos shared on Commons are creative as well. Note: intially the category was not empty, some images have been there (but deleted). If any image reappears here about the department or one of its cities, the category will be recreated exactly with the same code. This will be unnnecessary edits and won't help uploaders finding the appropriate categories. Look at the categories for other departments, we've got flags there for the department or their cities, or other cultural flags for cultural subregions. Defintely, there exists many flags in Nièvre, or the city of Nevers, or the Nivernais. In fact there should be a category for all departments of France (look at the parent category:Flags of departments of France : almost all departments are populated, some of them more than others, but this is just a current lack of data, in fact there could be many more images in them too, wanted for illustration purpose, e.g. for creating project banners in Wikipedia, or for illustrating cities, or articles about events). verdy_p (talk) 10:43, 14 June 2013 (UTC)[reply]

Armenia has issued a post stamp about its national musical instruments, but the nominator said, that the image must be deleted, because this is not Armenian, but Azerbaidzhan national musical instrument. In that case, I tend to believe organization, which issues postal stamps. And also, it is totally possible, that two neighbouring nations share some common musical instruments. Deleted. As noted by Fæ this is an excerpt of Michelangelo's Creation of the Sun, Moon, and Planets and thereby no copyright violation as this is in the public domain. However, I do not see how this falls into COM:SCOPE. The file has no decent description that would open the potential to make the upload useful. So which OS and browser is it? At the end it appears to be a random upload, probably to test the upload feature from a mobile. This test worked.   • Well, I thought they were obsolete six years ago. FWIW, please see a deletion nomination at en where my request to delete one of the bordered images was objected to because it was used in the flagicon template. Temporary decision

  • Kept We have to keep all in-use flags for now as we currently have no way for a proper on-wiki replacement due to the CommonsDelinker failure. Also fiddling with flags is highly problematic because of usage in protected templates or strange infoboxes sometimes requiring them to have a specific name. Flags should be individually checked/replaced and nominated for deletion once Delinker (or a properly working replacement) are available to us. I will not close this DR for now to enable further discussion. And a comment: I don't see a need to delete the bordered flags, they could still co-exist as a variant but all on-wiki usage should be changed to standard flag with border option (if possible, depends on wiki usage).--Denniss (talk) 14:49, 23 June 2013 (UTC)[reply]

Low resolution version of a professional photograph, for sale here as a stock photo for 600$, also used on the cover of a book written by the photographer [5]. The original uploader at en:wp may or may not be identical with it's author en:Justin Brice Guariglia. It's an old upload, but not old enough to be a case of Commons:Grandfathered old files.  Keep I see no reason to delete this. We know that many commercial photographers, with substantial pricetags elsewhere, also upload here under a free licence. They may upload only a handful, or a low-res version, but this does happen. It's something we should welcome, not an opportunity to play at being grown-ups by doing wiki administrivia! We also know that a couple of such photographers have been driven away from Commons in disgust at such behaviour.

If there's any indication that this wasn't uploaded by its photographer, then we should consider deletion. So far we've taken an article and an upload by en:User:GUARIGLIA+CHEN, speedy deleted one and are trying to delete another. We've behaved similarly to en:user:Brice777.

  •  Keep: 1) I am the person who realized that drawing and i currently work in the company that develop and manufacture the device. So this point would be easily solved.

2) This is a more difficult point to discuss. It is a medical device that is not for a wide audience as it is focused on severe migraine and headache. It is not a miracle solution and not a generic analgesic for everything, It offers an uncommon way (Because as of today it is still a new solution. The opposite approach than the -implantable- neurostimulation but with the same technology base) to use cranial neurostimulation. Then this file has an illustrative purpose. I can make a version without the branding if it is acceptable that way.

Of course Commons will start immediately - as suggested - to send hundreds of emails requesting permission to use a picture. And pigs can fly... Not wikimedia, only Mangoe. When it is possible It is better to check the basis of assumption before telling.
I was uploading pictures on Wikimedia with my own personal account "Ovp" before these mechanisms appear. I have read but I am not convinced. So I partially agree that I am not completely up do date.
However, you can simply read on the "Commons:permission" page: "This page is a proposed Commons guideline, policy, or process.
The proposal may still be in development, under discussion, or in the process of gathering consensus for adoption. References or links to this page should not describe it as 'policy'.

So, why such an agressive behaviour ?
One of our pictures was deleted even before I had time to take action. In less than 1 day. One user here just suggested that we simply took the pictures from Cefaly.ca, despite the evidence that this cannot be true. Are you kidding? So it becomes difficult for me to really take Wikimedia seriously.
On "Commons:OTRS" everything looks really simple until you really try to go through the mail templates. For instance, considering following case. The easiest: File:Illustration-CEFALY.jpg. I created this file by myself but as an employee of my company. So if I am the creator of the file, the copyright holder is the company itself, not myself. Who has got the authority for OTRS?
For some pictures it is a complete nightmare (e.g. the deleted one). One person takes the picture, another one makes some cleaning and cropping works on the picture. Later the branding on the device has changed and the corresponding modification was made directly on the picture… So the final picture is absolutely not the raw original photo…
And everyone who made modifications worked for the company that owns this file.
And if I sent a mail to Wikipedia commons asking for permission… so what? Everybody could send this email. What would be the difference if someone like you needs to make the decision?

Internationale melody

It is with great regret that I make this nomination, as I think the Internationale is an important melody which should be available at Commons. However, the result of a recent in-depth discussion (archived) at COM:VPC seems to be that it is at least very likely that the melody of the "Internationale" is still protected in France until October 2017 and that the keep comments of the earlier Commons:Deletion requests/Template:PD-Internationale were probably in error. Please refer to said VPC discussion for more details. Even if there is still some uncertainty, COM:PRP applies. As France is the country of origin for this melody, it seems we have to delete it here, with restoration possible in November 2017. I suggest adding the files to Category:Undelete in 2018, as this is a special case - normally, files become copyright free on 1st January of the year following 70 years after author's death, we have no category for undeletion in a specific month, and "Undelete in 2017" could prompt premature undeletion. --Gestumblindi (talk) 00:09, 12 June 2013 (UTC)[reply]

 Comment leaning to weak  Keep with snowball question: Other than France and based on w:List of countries' copyright lengths, only Côte d'Ivoire (life + 99 years) and Mexico (life + 100 years) would definitely copyright the Internationale melody while copyrighting non-posthumous works for life plus more than 80 years. May I kindly ask how many other countries and areas DO honor the very long French copyright term even if longer than their domestic copyright terms? If no fourth country in this world copyrights the Internationale melody, should 200+ countries and areas still "bow" to 3 countries (France, Côte d'Ivoire, and Mexico)? We do have even more works still copyright-restricted in even more countries and areas rejecting the rule of the shorter term, so we should consider a snowball case. Mexico doesn't copyright the Internationale melody, as the Mexico "life + 100 years" term doesn't apply to authors who died before 1952 according to Commons:Copyright rules by territory/Mexico, as I already mentioned in the archived VPC discussion linked in the nomination. - The problem here is that France is the country where this work comes from. Were it any other single country (except the U.S.) where the "Internationale" is still protected, Commons could keep it. The rule that works must be free in the U.S. and in the country of origin per Commons:Project_scope#Must_be_freely_licensed_or_public_domain already has an exception: Commons:When_to_use_the_PD-Art_tag#Why_do_we_allow_the_.7B.7BPD-Art.7D.7D_tag_to_be_used_for_photographs_from_any_country.3F. If we cannot get consensus on whether to allow another limited exception to this case, I suggest asking the Wikimedia Foundation to decide whether users in 200+ countries and areas should "bow" to France and Côte d'Ivoire in this case. To closing administrator: If affected template and files should be deleted, please arrange to transfer them to Canadian Wikilivres: in the similar way as Commons:WikiProject Public Domain/URAA review. Many files tagged Template:Not-PD-US-URAA are being transferred to Canadian Wikilivres.
