🏛 After many years of false starts, the Unified Patent Court (UPC) eventually opened on 1 June 2023. In the latest edition of the International Comparative Legal Guide - Patents, Trevor Cook of Bird & Bird discusses the ins and outs of the Unfied Patent Court. 💡 The UPC, established by the Unified Patent Court Agreement (UPCA), is a single court with exclusive jurisdiction as to the new European patents with unitary effect (uptake of which is now running at 25% of grants) and, for now, non-exclusive jurisdiction, shared with national courts, over “traditional” European patents that are not “opted out” of the UPC jurisdiction in those 17 (shortly to be 18) EU Member States that have ratified the UPCA – namely Austria, Belgium, Bulgaria, Denmark, Estonia, Finland, France, Germany, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Portugal, Romania (as from 1 September 2024), Slovenia and Sweden.
