Partners Nicholas Cardascia and Andria Simone Kelly Successfully Dismissed a Lawsuit Against One of the Firm’s Retail Clients

Partners Nicholas Cardascia and Andria Simone Kelly have obtained a tremendous appellate victory that dismissed a lawsuit against one of the firm’s retail clients. In this personal injury lawsuit, the plaintiff alleged to have sustained injuries as the result of coming into contact with one of the defendant’s employees in the checkout aisle of the defendant’s supermarket. The court ruled that the defendant established its prima facie entitlement to judgment as a matter of law by demonstrating that its employee was not negligent in the happening of the accident.
