I was working on a project to evaluate the compliance structure of one of the organizations. They wanted to hire a compliance head internally from existing employees and thought that this person should explicitly come from the legal department. However, we ended up hiring from a different department by looking beyond the university degree. Yes, a law degree is important, and as a lawyer who has been a head of compliance several times, I understand its value. However, the role of Compliance is not exclusive to holders of legal degrees. Here are the key qualities we focused on:  Courage to Speak the Truth: Understanding that sometimes saying the truth might jeopardize your role internally, especially when it involves sensitive issues with management supporting certain clients. However, having no fear to do so is crucial. Supporting the Organization: Knowing that what you do is to make the organization thrive, not block it. You are part of the business, protecting it while fostering a culture where every employee supports rather than scares. Strong Personality and Communication Proficiency: The confidence to speak up, say things as they are, and effectively communicate with management and the board. Strong verbal and written communication skills are essential. Integrity and Ethical Judgment: A steadfast commitment to upholding the highest standards of ethics and integrity in all aspects of their work. Analytical Skills and Attention to Detail: The ability to dissect complex regulations and ensure they are integrated seamlessly into our operations, with keen attention to detail to identify potential compliance issues before they escalate. Risk Management: Experience or a strong understanding of risk management practices to proactively mitigate potential risks. Fearlessness with Regulators: The ability to deal with regulators confidently and without fear, maintaining a calm and focused manner under pressure. Collaborative Spirit: The ability to work cross-functionally with various departments to foster a culture of compliance throughout the organization. Working under Pressure: The ability to manage the pressure of numerous regulations, rules, and compliance requests, understanding that compliance is often extraterritorial. Knowing how to navigate and manage these demands to ensure the right actions are taken is crucial. Training and Knowledge Sharing: The capability to deliver effective training sessions and share knowledge to ensure all employees understand and adhere to compliance standards. Continuous Learning: A dedication to staying current with regulatory changes and industry best practices, beyond formal education. I believe that the right fit for this role could be anywhere within our organization, not limited to any specific department. The role of a Chief Compliance Officer (CCO) is crucial in today's business landscape, where regulations and compliance requirements are becoming increasingly complex. Just like a skilled captain navigating a vast ocean, a CCO must steer their organization through these treacherous waters, ensuring compliance with applicable laws, regulations, and internal policies.

When you think about compliance independence within an organisation it should trigger the concept of "Church and State" in your mind. There should be a clear distinction for things to work well. A lot of compliance officers who I engage with in training sessions describe reporting lines that compromise their ability to be independent and impact how they execute. People are told to water down reports, change this, leave this out, and they are essentially forced into submission because its their boss. This is very wrong, but here's the thing... 1. Ideally before you accept a role make sure you have a clear understanding of the reporting lines. Some people skim or skip over that very important part in the job description. It is your responsibility to understand the structure and decipher how it could help or hinder your effectiveness. Then decide if its a Yes or a No for you. 2. Maybe its too late, maybe you said "Yes" when you should have said "No" and are now slowly starting to realise the conflict you have dived into. Empower yourself with information about best practice and be able to articulate why your reporting line needs to be independent. Then engage and advocate for what the ideal structure should look like. "Church and State" is the goal but at the very least some sort of measures to manage that conflict need to be implemented. 3. At the end of the day pushback is par for the course in the world of the compliance. Whatever your reporting line looks like you will face pushback about something or other. You will have to find your confidence and your voice and be able to fight for what you know is right. So whether the organisation agrees to change your reporting line or not, get in the arena and make yourself heard. I've said it 100 times and I'll say it again, if your happy place is sitting quietly in the back hoping no one sees you, then compliance is not for you. Happy Thursday.

This involves creative thinking and the ability to foresee potential problems before they arise. 6️⃣ Ethical Judgment: Integrity and ethical judgment are crucial in a role where you are advising businesses on compliance matters. You must be able to guide clients to operate not just legally, but ethically. 7️⃣ Project Management Skills: Often, you'll need to manage or oversee compliance projects, coordinate with multiple stakeholders, and ensure that all aspects of a compliance program are implemented effectively. 8️⃣ Interpersonal Skills: Building strong relationships with clients and maintaining trust are vital. The ability to negotiate, persuade, and manage conflict can also be crucial, especially when dealing with resistant stakeholders.
