It's alarming to read the New Zealand Law Society Te Kāhui Ture o Aotearoa report highlighting that New Zealand lawyers face significantly higher levels of depression, anxiety, and psychological distress compared to their international peers. This is particularly evident in criminal and family law, where the emotional strain is understandably immense. It is however encouraging to see many firms responding to these challenges by enhancing wellness-related perks and benefits. We’re dedicated to helping our candidates navigate any challenges they may encounter throughout their careers. In the bustling world of work, we often find ourselves pushing our limits, striving to meet deadlines, and achieving targets. However, it's crucial to remember that our health and wellbeing should never be compromised in the pursuit of professional success. Workplace-related sickness is a reality that many of us face, yet it often goes unaddressed due to a lack of awareness or fear of repercussions. Under UK employment law, every employee has the right to a safe and healthy working environment. This includes protection from physical harm as well as mental stressors that could lead to illness. If you're suffering from workplace-related sickness, it's essential to understand that you are not alone and there are legal protections in place to support you. An employment solicitor can provide invaluable guidance during such challenging times. They can help you navigate the complexities of employment law, ensuring your rights are upheld and you receive the support you need. Whether it's dealing with unfair dismissal due to sickness absence, discrimination or ensuring reasonable adjustments are made for those with long-term health conditions, an employment solicitor can be your advocate. Remember, your health is not a commodity to be traded for professional success. It's okay to take a step back when needed and seek help when things get tough. We spend a significant portion of our lives at work; it should be a place that nurtures us, not one that contributes to our ill health. If you're struggling with workplace-related sickness, reach out to I or the team at Magara Law today. We can help ensure your rights are protected and guide you towards a healthier work-life balance. After all, we're all human beings before we're employees. [email protected] 01869 325 883 buff.ly/3KD5lKp #WorkplaceWellbeing #EmploymentLaw #EmploymentSolicitor #HealthAtWork

In our May Newsletter, we reviewed an Ontario Human Rights Tribunal decision, L.C.C. v. M.M. that upheld the terms of a settlement agreement which had been breached by the employee complainant. The decision was notable for its strict contract law approach, as opposed to the more nuanced, policy-driven approach typical in employment law. The Tribunal adopted this approach due to the facts of the case and to avoid creating a "disincentive for respondents to settle human rights applications." We noted that such a strict approach might be expected in these circumstances, particularly if independent legal advice and a negotiation process were involved. A recent B.C. Human Rights Tribunal decision, Fyffe v. University of British Columbia, illustrates a different outcome when there hasn't been independent legal advice or an adequate negotiation process. In this case, the release of the claim in the settlement agreement did not withstand scrutiny and was not upheld. It is important to note the differing circumstances and the different legal approaches in the two decisions. Read more here in our July newsletter: https://lnkd.in/gc5exaDg

Defending #whistleblowing claims in the #education sector requires a thorough understanding of the legal framework and a proactive approach to managing risk. In his article, Nick Hobden shares the strategies and considerations involved in defending these claims.
I lead a team helping organisations and people with their employment and equality issues to secure the right outcome. I am an expert in TUPE. My client base includes manufacturing, services, charity & education clients.
As specialist employment lawyers practising in England and Wales, a significant portion of our work involves defending whistleblowing claims for education sector clients. They are often brought with or on the back of unfair dismissal and discrimination claims. These whistleblowing claims often entail complex legal issues, and usually revolve around allegations of whistleblowing detriment, dismissal from employment, and harassment. In this article, I share the strategies and considerations involved in defending these claims, while also addressing the concept of automatic unfair dismissal and the implications of uncapped compensation awards from employment tribunals. https://lnkd.in/eK8DRgfR #whistleblowing #educationlaw #employmentlaw
