In New York City, Tenant Protection Plans (TPPs) are crucial when residential buildings remain partially occupied during ongoing construction. As required by Article 120 of Title 28 of the NYC Administrative Code, TPPs must be filed with the NYC Department of Buildings to ensure the safety and protection of tenants. These plans detail how occupied areas will be separated from construction zones, highlighting protective measures such as barricades, temporary walls, signs, and more. They also outline all means of egress for tenants and entrances for construction personnel. TPPs are often developed in phases, especially when buildings are set to receive multiple Temporary Certificates of Occupancy (TCO). As construction progresses, these plans must be updated to reflect any changes in safety logistics, including site safety plans that cover external protections like sidewalk sheds. Local Law 147 Reminder! Starting December 11, 2024, the definition of a "major building" under Section 202, Chapter 2 of the NYC Building Code will be revised. Previously defined as a building that is 10 or more stories or 125 or more feet in height, the new definition will include buildings that are 7 or more stories or 75 or more feet in height. However, current additional criteria—such as a building with a footprint of 100,000 square feet or more, regardless of height, or a building designated as a major building by the DOB Commissioner due to unique hazards related to construction or demolition—will remain unchanged. With this definition revision also comes new requirements for new building projects. Before the change, these incoming buildings between 7-9 stories only needed one registered construction superintendent on-site. However, with this change, along with the updated regulations for construction superintendents (removing the exemption for major buildings that require an SSM/SSC), a new major building (7 stories or 75 feet or taller) will now require both a registered construction superintendent and a site safety manager or coordinator. The updated definition will apply to initial permits issued and permit requests submitted on or after December 11, 2024. Permits issued and requests submitted before that date will not be affected.
