The Council of Europe’s AI Convention is facing key decisions this month, with the most consequential pending issue being the scope of the convention. The EU is also finalizing the AI Act, while the EU Court adviser sided with the Commission in the Google Shopping case. Additionally, the Commission is examining the relationship between tech multinational Microsoft and ChatGPT-maker OpenAI, and the EU is working on new cybersecurity measures. ➡ There is a strong attention of the Italian Data Protection Authority about Artificial Intelligence. ✔ Following the well known temporary ban on processing imposed on #OpenAI by the Authority on 30 March of last year, and based on the outcome of its fact-finding activity, on January 2024 the Garante notified breaches of privacy law to OpenAI based on the collected evidences. ✔ Also, on March 2024 the Garante Privacy opened an investigation into OpenAI's "Sora" (the new AI service able to create dynamic, realistic and imaginative scenes from short text instructions), asking OpenAI to provide information on the #algorithm that creates short videos from text instructions. ✔ Finally, this week the Garante wrote to Italian Parliament and Government by highlighting it possesses the necessary competence and independence to implement the #AIAct, in line with the objective of ensuring a high level of protection on fundamental rights. 📢 "Given its impact on people’s rights, AI should fall within the jurisdiction of Authorities with stringent independence requirements, such as #Privacy Authorities, also due to the close interrelation between artificial intelligence and data protection and to the expertise already acquired with regard to automated decision-making.", the Garante wrote in its own communication to the Italian Parliament and Government. 🔊 In the end, it is evident that on the one hand the Garante is stressing (as well as investigating) the synergy between #AI and #DataProtection, and on the other hand it is pushing for their application by a single independent Authority. The AI Act (the EU Artificial Intelligence regulation) has passed the final approval by the EU Council The first-of-its-kind law is expected to reshape business operation of #AI in Europe, from health care decisions to policing. It bans some “unacceptable” technologies while enacting stiff guidance for other high risk applications. For example, it outlaws social scoring systems powered by AI and any biometric-based tools used to guess a person’s race, political leanings or sexual orientation. It bans the use of AI to interpret the emotions of people in schools and workplaces, as well as some types of automated profiling intended to predict a person’s likelihood of committing future crimes. In some cases when emotional recognition is allowed, the users have to be warned. Some categories of AI should follow transparency and #security rules. Werner Vogels, CTO of Amazon , warned the EU against overregulating AI, pointing to the example of its signature data privacy law, known as GDPR, which he described as a very “thick” book. Yann LeCun, chief AI scientist at Meta, told to CNN that “There are clauses in the EU AI act and various other places that do regulate research and development. I don’t think it’s a good idea”. A rare event – geopolitical consensus! The #UnitedNations unanimously adopted the first global resolution on #artificialintelligence – a useful step towards establishing international guardrails and ensuring responsible and ethical use of #AI technology. The #UN calls on governments to get involved in all levels of design, development, and implementation of AI technology to eliminate the risk of “improper or malicious design development” of AI systems. How much of this plays out in practice remains to be seen but an encouraging and important development that reinforces the need for a collaborative approach to manage AI-related risks with greater responsibility, accountability and transparency if society as a whole is to benefit from the pace of AI advances expected in the coming years. #AIPolicy #innovation #regulation #governance #UNresolution

The vote took place in the committee composed of each country’s deputy permanent representatives to the EU, called COREPER I. The ambassadors unanimously rubber-stamped the political agreement first reached in December. The AI Act would ban systems that present an “unacceptable level of risk,” such as predictive policing tools already in place in several US states, or social scoring systems, like those used in China, to classify people based on their behavior. Specifically targeting the viral generative AI models such as ChatGPT, the AI Act would also require content created by such systems to be labeled. Finally, the bill prohibits these models from publishing summaries of copyrighted data. 📊 Data Protection Trends for 2024: AI Policy And Governance In early 2023, as AI gained widespread popularity, governments worldwide were apprehensive about its effects on data privacy and the lack of comprehensive regulations. In March 2023, Italy was the first country to temporarily ban ChatGPT because of privacy concerns. One of the main concerns was that OpenAI, the company behind ChatGPT, was using people’s personal data without consent to train the AI model. Concern was also raised about children’s privacy and the lack of proper age verification tools. In response, OpenAI created a form for European users that allows them to opt out of data processing and developed an age verification tool to prevent children under the age of 13 from using the platform. However, governments’ concern about potential privacy breaches by this platform resulted in the creation of a ChatGPT task force by the European Data Protection Board. ChatGPT’s case has spurred governments worldwide into a race to develop suitable AI regulations.
