In reaction to the Federal Energy Regulatory Commission’s vote on #CP2 #LNG project, Anastasia Gordon, WE ACT for Environmental Justice’s Federal Policy Director has this to say:  “FERC’s authorization of CP2 misses the urgency of the moment, ignoring the profound and devastating impacts it will have on neighboring communities, public health, the economy, and the climate for many years to come. Continuing to greenlight LNG export projects jeopardizes the health and safety of frontline and environmental justice communities, drives up domestic energy prices, and perpetuates the climate crisis. This is why the Administration’s pause on permitting gas exports as DOE updates its public interest analysis is so critical. Accounting for these impacts should result in one conclusion – denial of new LNG projects like CP2 because they are not in the public interest. This decision highlights ongoing judicial demands for FERC to clarify its methods for evaluating greenhouse gas emissions. The court criticized FERC for not explaining why it departed from its previous policy on assessing downstream emissions, as established in a 2021 decision. Additionally, the court ruled that FERC must provide a more comprehensive analysis of cumulative NO2 emissions or revise its approach entirely. The DC Circuit ruled #FERC didn't adequately assess the emissions impacts of the proposed Commonwealth #LNG facility in Louisiana. Specifically that it failed to comply with NEPA by (1) not determining whether the project's #ghg emissions would be significant and (2) inadequately assessing the cumulative effects of nitrogen dioxide emissions. The central issue was the adequacy of FERC's explanation for *not* making a “significance determination” in its NEPA analysis of Commonwealth's GHG emissions. Petitioners contended that FERC did not justify its deviation from its approach in a previous order involving a (very technically different) Northern Natural replacement project, when FERC compared the projected emissions to national levels and concluded GHG emissions would not be significant due to their marginal increase in national emissions of 0.000006%. [The petitioners argued that the converse was true for the Commonwealth LNG project — with a projected 0.06% increase in national emissions, that it would exceed any reasonable significance threshold.] The Court didn't weigh in on whether the petitioner's application of the Northern Natural case had any substantive merit, but found FERC erred in its failure to address the argument and explain why its approach in Northern is inapplicable to Commonwealth. Consequently the case has been remanded to FERC for reconsideration. It seems like the question of what is deminimus (in the case of Northern) is much easier to deal with than a question of what is significant, especially on a global scale.  ( Thomas L. Urge the ACC to stop big utilities from siting gas plants without environmental review UNS Electric, a sister company to Tucson Electric Power, is trying to create a loophole to avoid environmental reviews and scrutiny regarding the impact of siting a large gas power plant. Currently, these larger plants must get a certificate of environmental compatibility (CEC) from the Arizona Power Plant and Line Siting Committee where they evaluate the impacts of the proposed plant versus the need. If UNSE is successful with creating this loophole, other utilities – APS, SRP, and TEP – will follow and we could end up seeing a rush of big gas plant sitings that have no environmental review. In April, the Arizona Power Plant and Line Siting Committee voted 9-2 to deny UNSE's request to eliminate the CEC requirement. Now, UNSE has appealed that decision to the Arizona Corporation Commission (ACC).Sign the petition to the ACC.
