Now that we've had some time to dig into OSHA's proposed Emergency Response Rulemaking, we're even more "alarmed" (pun intended) than we were at first pass. At the very least, the proposed rule creates an administrative nightmare for employers that engage in any level of emergency response activities, with numerous new policy, procedure, and program requirements. It also includes a host of onerous substantive requirements that could cause a lot of emergency services to close up shop. FYI – OSHA recently stated uploading the citation text for all federal violations to the OSHA webpage. Now the public can see the specific citation language for each violation online (going back to 2012 OSHA inspections) in addition to the OSHA standard number and paragraph. Use OSHA’s Establishment Search to search for an OSHA enforcement inspection by the name of the site’s company (establishment). Link provided below. https://lnkd.in/gdRThXpk Once you open a specific inspection, you can scroll down to the Violation Items and click on the individual Citation ID to read the citation text. Isn't it frustrating when you think (no, you know, or as close to knowing as possible) that you are right but OSHA just won't listen - or get your argument? This happens all.the.time. You get cited and you disagree. You tell OSHA why. OSHA seems like it is not listening. Know this, yes, OSHA is listening. But, if that listening does not translate into action in your favor, there is a quite simple remedy. You go to Court and you have the judge decide everything! Why have someone, or an entity, decide such a critical matter for you when they are adverse to you? Have a judge do it. Never feel victimized - never feel like you have no options. No, march into trial and try the case. There, you will be heard! #OSHA #safety
