Major milestone alert! The U.S. Department of Labor has issued its first e-certification in our modernized Permanent Labor Certification Program (PERM) system. With support from a US Technology Modernization Fund (TMF) investment, we’ve developed a new module that electronically delivers a two-page certification to filers instead of printing and mailing up to 20 documents. The ongoing PERM modernization will lead to shorter processing time for American employers looking to sponsor skilled foreign workers and for immigrants applying for visas. 📢 Good news for French companies! The government has relaxed rules related to tax paid by French companies hiring foreign nationals from outside the European Union/European Economic Area/Switzerland. Employers of French residence permit holders are exempt from paying the foreign worker tax. Additionally, employers subject to the tax only need to pay it once annually, instead of paying an invoice sent by the General Directorate of Public Finance after each hire. Approximately 15 RCIC/lawyer colleagues approach me every month for a second opinion on their ICT applications, providing GCMS Officer Notes, particularly those associated with refusals. The primary processing center responsible for these applications is CPC Edmonton. Upon reviewing several cases handled by this office, it is evident that despite the completeness of applications and adherence to criteria outlined in IRCC PDIs and R205(a), they have been inexplicably refused. Upon closer examination of the GCMS notes, it becomes apparent that decisions made after October 2023 lack consistency in the reasons provided for refusal. In some instances, officers cite criteria specific to C11 applications for a C61 application, creating confusion. Furthermore, discrepancies arise, such as an officer processing an ICT application with C11 specifications. Additional inconsistencies include issues with "definitions", a lack of understanding of the share structure of companies in Canada, and unwarranted personal opinions expressed by officers, such as questioning the rationale behind a parent company choosing Canada for expansion!!! It is imperative to emphasize that decisions regarding immigration applications should strictly adhere to the guidelines set forth in IRPA, IRPR, and related policies, PDIs, and guidelines. To address these concerns, I recommend that CPC Edmonton take proactive measures to train its officers to ensure a consistent approach to both approvals and refusals. Training initiatives should emphasize adherence to established criteria and discourage the insertion of personal opinions into the decision-making process. This will not only enhance the integrity of the immigration application process but also contribute to a more transparent and equitable system.
