Publication Alert! TITLE: STRENGTHENING THE LEGISLATIVE FRAMEWORK FOR INSTITUTIONAL ARBITRATION IN NIGERIA AND SUB-SAHARAN AFRICA: QUO VADIS? As arbitration is on the rise, sub-Saharan Africa is not left out as the last decade has witnessed an uptick in the growth of institutional arbitration in the region. According to the ICC, an estimated 5% of its caseload in 2019 was derived from 130 parties from sub-Saharan Africa, with Nigerian (19), South African (13) and Mauritian (10) parties taking the lead. While these figures indicate the growth of arbitration in Africa, they also reiterate concerns about the position reported by the International Bar Association (IBA) in 2015 that international arbitrations involving African parties still largely occurred in Europe. This entails that arbitration institutions in Africa are not given much consideration or selected as the seat. Even when parties choose arbitration in places like West Africa, especially Nigeria, it has been noted that ad hoc arbitration is often selected over institutional arbitration. Against the foregoing backdrop, this essay examines the state of play of institutional arbitration in sub-Saharan Africa with emphasis on Nigeria in a bid to find its progress, challenges, and how strengthening the legislative framework will boost its growth in the region. #Arbitration #institutional arbitration

Switzerland maintains its globally leading position in international arbitration The newly published ICC Dispute Resolution 2023 Statistics confirm the popularity of Switzerland, Swiss law and Swiss arbitrators in international arbitration: - Switzerland is among the top three countries selected as place for arbitration - Swiss law is the second most frequently selected law by contract parties - Switzerland was the third most frequent nationality of arbitrators The ICC statistics for 2023 reconfirm the trust that parties from all over the world place in Switzerland, Swiss law and Swiss arbitrators. Switzerland has a long standing tradition to serve as the seat for international disputes thanks to its arbitration friendly legal framework, stability and business minded environment. Switzerland also offers a large pool of highly qualified Swiss arbitrators often with a good command of several languages. The popularity of Swiss law as the law governing the contract may be explained by Switzerland’s liberal economic order. VdA participates in Arbitration initiatives in Mozambique Mariana França Gouveia participates as a speaker in the Intensive Course of Arbitrators and in the II International Arbitration Conference, initiatives promoted by the Internationalization Commission of Mozambique. The first of these events, the Intensive Course for Arbitrators, will take place on June 17 and 18, with an opening session conducted by Mariana França Gouveia, which also accompanies the session "Simulation of arbitration hearings with resolution of practical cases". The course is also composed of the following modules: "Arbitrator Statute", "Efficient conduct of the arbitral process" and, finally, "Arbitration session". On June 20, the II International Arbitration Conference will be held, in which VdA's lawyer participates as moderator in the panel "I Arbitration in Mozambique: Relevant Issues", composed of the themes "Arbitration Law: New Developments", "The Articulation and Cooperation between Arbitral and Judicial Tribunals", "Public Law Arbitration" and "Labor Arbitration". #VdA #arbitration #Mozambique #arbitrationlaw
