The 2024 Farm Bill draft has just introduced a controversial amendment proposed by Rep. Mary Miller, R-Ill., which could reshape the entire hemp industry. This amendment aims to redefine hemp to include only naturally occurring, nonintoxicating cannabinoids, limiting THC and THCA content to less than 0.3% on a dry-weight basis. If passed, this could shut down a significant portion of the cannabinoid hemp market, including the lucrative THCA seed market. Reactions from the industry are mixed and heated. In a study by the National Institute of Standards and Technology (NIST), results indicated that an overwhelming majority (93%) of smokable hemp products contain levels of THC that would classify them as “illegal” under federal law. This data raises questions about the marketing and regulation of hemp items, particularly in light of the 2018 Farm Bill that defined hemp as having no more than 0.3% delta-9-tetrahydrocannabinol (Δ9-THC).

Last year we produced an important, timely, and prophetic policy brief for California local governments, particularly the County of Santa Clara Public Health Department. Our report delved into the unintentional consequences of recent California legislation (and federal legislation, also known has the Farm Bill Loophole) which legalized the manufacture and sale of products intended for human consumption that contain ingredients derived from industrial hemp. While the intent may have been to legalize hemp-derived cannabidiol (CBD), which is usually non-intoxicating, loopholes have allowed psychoactive hemp products to be sold. The unfortunate byproducts of these misguided regulatory approaches has resulted in the proliferation of legal & illegal intoxicating hemp products sold w/o age restrictions across country (& in CA) and marketed in ways attractive to youth.
