This is as interesting view of the generally inscrutable market for litigation counsel. The first part about making decisions based on data about individual attorneys, however, rings a bit hollow. Success in a specific litigation is rarely a simple binary of win/loss. The vast majority of cases end in settlement, with most trial lawyers having a relatively small sample size for true wins and losses. Summary judgment ups the number, but the lead trial lawyer may not deserve the lion’s share of the credit there. Ultimately, success is a happy client, but I am aware of no database of that information. So I will continue my imperfect search for new clients and cases, while pointing out my successes along the way.
