NY Paid Family Leave provides eligible employees job protected paid time off to bond, care or assist with newborns or family members. One question that we receive here is at Central Staff Services, Inc. is can the employee collect unemployment while on Paid Family Leave. The answer is no, the employee is not entitled to unemployment benefits. However, if the employee the chooses not to return to work they may file a claim & would be subject to the normal eligibility requirements under NYS unemployment insurance law. American workers -- from senior executives to retail clerks -- are reaching a breaking point as they struggle to balance the growing demand of caring for family members, while doing their jobs. An estimated 29 million people are working, while providing care -- which itself is often the equivalent of a part-time job in terms of hours of care. Many are doing so at a great cost to their career. They may shift to part-time, turn down promotions, or leave the workforce all together. Companies, which have long offered maternity and paternity benefits to attract and retain younger workers, are beginning to offer support for those caring for older family members. Among those benefits: adding parents to health insurance plans, two weeks of paid leave annually to care for an immediate family member, and connecting workers with care specialists. We’ve got a handful of state updates this week: In #California, starting 2.15.24, the #EDD will no longer be issuing benefits to a Bank of America debit card. Claimants will instead receive a new Money Network prepaid debit card. #Washington’s Employment Security Department has released updated employer toolkits for 2024. Paid Leave #Oregon has filed Permanent Administrative orders for 16 administrative rules, effective 1.12.24, relating to appeals, assistant grants, benefits, and more. In #RhodeIsland, the #DOL has released an updated version of the TDI/TCI combination workplace poster. We recommend swapping out the current poster with the updated one without delay. And last but not least, we have some big news to share about #Vermont’s upcoming Family and Medical Leave Insurance Program…Governor Scott has released an announcement that employers with two or more employees will soon have the opportunity to begin designing a program plan to fit their business and employee needs with The Hartford as early as 2.15.24. 🚨#HRnews🚨 On January 1st, Colorado became one of the States to add Paid Family and Medical Leave Laws for employees. The Family and Medical Leave Insurance Program (FAMLI), will allow Coloradans to access paid time off from work when they need to recover from a serious health condition, care for a family member, bond with a new child, take safe leave or take leave related to a family member's military deployment. State paid leave programs can help some small employers – who might not be able to afford to provide paid leave on their own – match the benefits of larger employers, increasing their competitiveness. Starting July 1, 2026, Maryland's Family and Medical Leave Program will require all employers to provide paid leave for up to 12 weeks to eligible workers caring for themselves or family members. Employers can choose between the State Plan, commercial options, or self-insurance to comply. Contributions, based on payroll, will begin July 1, 2025, with benefits becoming available a year later for all State-run plans. Non-compliance could result in penalties and legal repercussions for businesses operating in Maryland.
