Very strong response to DOJ Statement of Interest in the RealPage MDL. The RealPage JDG characterizes the DOJ brief - "It reflects an attempt to expand the Sherman Act beyond the boundaries of well-established and controlling antitrust jurisprudence," their response said. "The court should reject this." It continues: "Lastly, DOJ misstates the law on direct evidence, arguing it “need not be tantamount to an acknowledgement of guilt.” SOI at 12. This contradicts controlling precedent. Hyland v. HomeServices of Am., Inc., 771 F.3d 310, 318 (6th Cir. 2014) (“[D]irect evidence is ‘tantamount to an acknowledgement of guilt.’” (quoting In re High Fructose Corn Syrup Antitrust Litig., 295 F.3d 651, 662 (7th Cir. 2002))). How do you make a little known and complicated new law even more difficult for the general public to understand and comply? You have have a federal judge find the law unconstitutional ... but only for the parties in that specific case. That's right, on March 1st the Northern District Court of Alabama held that the Corporate Transparency Act was unconstitutional, but his ruling only applied to the plaintiffs in that case. The 53 page opinion left the door open to a legislative fix with the inclusion of "jurisdictional hook" language. The ruling itself will face scrutiny at the 11th Circuit Court of Appeals via appeal by FinCEN. It is uncertain what impact a lengthy appeal of the ruling will have on the current CTA filing deadlines, if any. For the time being, the CTA is still the law for 99% of small businesses around the country and compliance is still mandatory to avoid $500 per day fines.
