"Administrative finality" and the Administrative Procedure Act are the big issues present in (to me) a top-2 SCOTUS decision this year in Corner Post v. Board of Governors. Michael Molzberger, Hee Soo Jung, and I break down the decision - and ramifications - in the blog post linked in the comments below. Big takeaways : - This changes when APA-based claims accrue -- not all administrative challenges -- so even in terms of subject matter, it applies for some -- but not all -- types of claims. (So yes to Endangered Species Act claims, but generally no to Clean Air Act claims, which have their own SOL!) - This is a decision a lot of folks slept on. We see major effects on issues like discrimination and in other areas reliant on the APA's SOL (which Congress could change!) This means the regulated community needs to take a hard, claim-by-claim look across their footprint. (We're happy to help on that!) - This probably changes how Congress works as much as Loper Bright does - taken together, it's probably closer to creating a "tsunami" (as Justice Jackson says in dissent) than nothing. Bravo to the State of New Jersey! The New Jersey Department of Environmental Protection (DEP) announced its intent to modernize a suite of regulations, known as REAL (Resilient Environments and Landscapes), to better protect communities from #coastalflooding, #sea-levelrise, and other #climatechange impacts. This makes New Jersey the first state to initiate a comprehensive update of land resource protection regulations to address climate change effects. The REAL reforms will amend existing flood hazard, stormwater, coastal zone, and freshwater wetland regulations statewide to address climate change impacts, improve water quality and flood protections, especially in vulnerable communities. https://lnkd.in/g8wxtuJv #NJFAM

Join MCEA and ask your legislators to support fixing Minnesota's definition of "public waters" to ensure that all waterways in the state are protected. Take Action - https://lnkd.in/gcnCKy_b This legislative session, a bill was introduced to help protect all public waters in Minnesota, which is especially critical now that the federal government has narrowed the definition of waters that are protected under federal jurisdiction. HF 3385 (Pursell) / SF 3558 (Kunesh) are simple, common-sense laws that would put the Minnesota Legislature on record that the current definition of a public water in statute applies to every river, stream, and lake in Minnesota. Public waterways deserve protection even if they are not listed on the "Public Waters Inventory," a 1980's list and map that attempted to document public waters in the state. Opinion: Idaho needs leaders who will address water rights and find solutions "As a rancher in eastern Idaho, I know firsthand that water is life. Our agricultural operations depend on it, and controlling its use carries high stakes for all of us. People like me rely on water to stay in business and to provide Idahoans with commodities or the beef they need. But what happens when there's not enough water to go around? Groundwater users have already had their rights significantly reduced and faced a curtailment order that would have had a massive impact this spring. It’s a problem affecting our livelihoods—and soon, it will affect yours too. Water rights are a complex issue that requires Idaho's leaders to dig deep for solutions. We need lawmakers who are ready to listen to the people affected and address these critical issues, which are a true matter of life or death for our businesses and all businesses that serve Eastern Idaho."
