I recently joined the Paul Finebaum Show to talk about #NIL and some of the legal issues currently facing college athletics. For those who love #NIL and those who hate it, or are at least sanguine about what comes with it at times ... my winter session intensive course, "The Name, Image, & Likeness Revolution in College Athletics," begins today Seton Hall University School of Law. Students will review the history of amateurism and why #NIL represents such a dramatic shift, examine the NCAA guidance, explore the state statutes, hear the perspectives of #NIL and athlete empowerment advocates and of #NIL critics. We'll review contracts, some well-drafted and some really badly drafted, negotiate deals from a variety of perspectives, with attention given to what each side really values in a potential deal. It is a course I'd love to bring to the world but this year only for Seton Hall University School of Law students.

Interesting topic for those interested in sports and the law like myself.

After entry of yesterday’s TRO prohibiting the NCAA from enforcing its multi-time transfer rule, the association has issued a memo to member schools with guidance on the ramifications of the order. Of note, the NCAA says that if a multi-time transfer plays during the 14-day TRO period without a waiver, and the TRO is later overturned, that will count as a season of eligibility for the athlete (see answer to question No. 4). This interpretation of the court’s order would essentially be mooted if the court enters a preliminary injunction on Dec 27, since a preliminary injunction would likely be in place for months. And the basketball season would be over by the time the case is decided on the merits. I expect the court will enter a preliminary injunction that extends the TRO. But it would be reasonable for schools to wait and see what the court does before letting its multi-time transfers play. Some already played last night. I also expect we’ll see the state AGs who sued the NCAA now ask the court to clarify its order, to see if the NCAA’s interpretation is accurate and/or in compliance with the order. On March 1, 2024, following the federal judge's preliminary injunction in the State of Tennessee and Commonwealth of Virginia vs. NCAA case, the NCAA released a letter in which they detail certain suspensions on their enforcement. Specifically, the Division I Board of Directors has decided to temporarily halt the enforcement of investigations related to third-party involvement in NIL activities (aka Collective involvement). Despite this pause in enforcement, it's important to note that several key NCAA policies remain in effect and will continue to be enforced. These include the prohibition of pay-for-play, direct institutional payment for NIL deals, and the quid pro quo requirement. #NCAA #NIL #collegesports #collegeathletes #sportslaw
