The Equal Employment Opportunity Commission (#EEOC) has issued its new "Enforcement Guidance on Harassment in the Workplace," replacing its previous guidance from 25 years ago. While not legally binding, this guidance offers crucial insights into the EEOC's interpretation of federal laws against harassment. Employers are advised to review the new guidance, update their policies, and consider additional training for supervisors to prevent harassment in the workplace. In an interview with Mark F. Kluger, Matt Gonzales of SHRM seeks the reasons for the substantial increase in the number of discrimination charges filed with the federal government in the fiscal year 2023, as described in the U.S. Equal Employment Opportunity Commission’s latest annual report. Mark explains that although the MeToo and BLM movements significantly increased awareness and sensitivity to workplace harassment and discrimination nothing has changed the workplace dynamic more than the pandemic. He goes on to recommend that employers must ensure all their human resources related decisions have legitimate, documented, and non-discriminatory reasons to support them. A new Code of Good Practice on the Prevention and Elimination of Harassment, came into effect on 18 March 2022. The Code, issued in terms of the Employment Equity Act (EEA), replaces the previous Code of Good Practice on Handling Sexual Harassment cases in the Workplace and gives a more detailed meaning to the prohibition in section 6(2) of the Act which simply states that harassment is a form of unfair discrimination if it is linked to any of the prohibited grounds for discrimination mentioned in section 6(1).
