DHS wants to collect and analyze photos of migrant children at the border to improve facial recognition tech. Let’s get this straight— we can’t give them safe pathways to living in America, but you can use them to upgrade the surveillance state? Given DHS’s use of AI appears to violate federal policies governing the responsible use of AI, to continue to feed a system that is making life-impacting decisions is problematic. “If we pick up someone from Panama at the southern border at age four, say, and then pick them up at age six, are we going to recognize them?” Time and time again, we see tech being used to exclude and deter migrants & now minors are being denied consent & their privacy. https://lnkd.in/gQXN_nKx

Understanding Border Security: More Than Just Walls and Fences. As a former Customs and Border Protection Chief of Staff, and in countless interactions with clients embarking on cross-border business projects, I've encountered a common misconception - that border security revolves solely around physical barriers. In truth, border security is an intricate weave of technology, human resources, international law, commerce regulation, and diplomacy. Advances in digital platforms are playing a significant role in modernizing border security and improving efficiency for international trade. Drones for air surveillance, AI algorithms for contraband detection at entry points, and smart identity verification systems - these are transforming the way we secure our borders while still facilitating the free flow of legitimate trade. Starting 6 October 2024, the Entry/Exit Scheme (EES) will be implemented, requiring travelers to submit fingerprints and facial biometrics. No issue with this bill, but a lot of the questions being asked by this leg are already answerable. If you look through DHS's existing AI inventory you find extensive planned and in-use AI applications to secure the border. Examples include vehicle detection and tracking, "item of interest" detection systems, used to identify humans and trafficked items, AI powered surveillance towers, and many more. It's clear the DHS has already hit the ground running on AI border concerns. Perhaps a better question from congress is whether DHS has the funds and talent needed to support this build out. That info, however, probably could already be acquired through the budget request process. All this said, something worth including is analysis of existing development and procurement processes and regulations to identify bottlenecks on use, and likewise get a better sense of gaps in use limitations that might lead to overreach and violations of civil liberties. Most DHS border systems are likely "rights impacting" and therefore procurement and use would be governed by the OMB's new AI governance policies which will require systems to go through external testing, impact assessments, and other requirements. This process could indeed help limit civil liberties violations but will also necessarily delay any quick action. I don't have major issues with these rules in the law enforcement context but I do think congress should ensure the policy doesn't just create paperwork for paperwork's sake. DHS's use of AI requires unique care in policy design given the combined civil liberties risks and real capacity issues. Congress should focus on compiling as much information as possible on process and safeguards to help us thread this policy needle. https://lnkd.in/eBcKqJfq
