Last week, the New York Department of Financial Services (DFS) finalized a sweeping rule governing the market conduct of pharmacy benefit managers (PBMs) in the state. The DFS rule establishes new standards designed to protect independent pharmacies and covered individuals, including: -Pharmacy network contract standards that protect independent pharmacies from lower reimbursement rates. -Requirements for PBMs to publish information on their formularies and pharmacy networks. -Limits on practices that could steer patients to affiliated pharmacies. The market conduct standards apply to any entity that provides pharmacy benefit management services for self- or fully-funded health benefit plans, the Medicaid program, and state employee benefit plans.
