❗️ THE TAS/CAS Tribunal Arbitral du Sport / Court of Arbitration for Sport / Tribunal Arbitral del Deporte UPHOLDS THE APPEAL FILED BY SIMONA HALEP AND REDUCES HER PERIOD OF INELIGIBILITY FROM 4 YEARS TO 9 MONTHS 💉 Simona Halep, the Romanian tennis star, was banned from competing after a prohibited substance (Roxadustat) was found to be present in a sample collected from her on 29 August 2022 during the US Open. She contested that it was the result of contamination. Additionally, she was charged based on her Athelte Biological Passport as a result of a blood sample taken on 22 September 2022 that allegedly demonstrated use of a prohibited substance/method. 👩⚖️ The CAS Panel has unanimously determined that the four-year period of ineligibility imposed by the International Tennis Federation Independent Tribunal is to be reduced to a period of ineligibility of nine months starting on 7 October 2022, which period expired on 6 July 2023. 📝 Specifically, the Panel determined that whilst Ms Halep did not exercise utmost caution as to the contamination, she bore no significant fault or negligence. New article. The resolution of disputes in the Badminton World Federation (BWF). An interesting example of a complex multi-tiered mechanism in the grand scheme of sports-related dispute resolution, involving elements that seem like arbitration, but which is mostly a reflection of expert determination. It is fascinating that the BWF is incorporated in Malaysia as an inter-governmental organization despite not being set up by states or governed by international law. Given its small case load the mechanism screams for simplicity and as argued in a forthcoming article in the San Diego Journal of International Law, the introduction of 'predatory' gambling in the lower-tiers of individual sports risks match-fixing on a grand scale, which in turn requires these quasi-judicial mechanisms to become far more proactive. #sportlaw #arbitration #badminton #internationalorganizations

" The award reveals how the CAS Ad Hoc Division and the panel, to the detriment of all involved and to the sole benefit of the presiding arbitrator’s client, Romania, created a process that prevented Jordan Chiles, USA Gymnastics, USOPC, and the IOC (four of the five “Interested Parties”) from meaningfully participating in the process. Gymnast Ana Maria Barbosu’s award is tarnished. The CAS Ad Hoc Division and the panel also robbed Sabrina Maneca-Voinea of the opportunity to be heard by an independent tribunal. The award reveals how the panel and the CAS Ad Hoc Division actively shaped the process toward its ultimate outcome in favor of the presiding arbitrator’s client, Romania. This was to the detriment of all the gymnasts, the detriment of CAS arbitration’s reputation, the detriment of international arbitration and to the detriment of basic principles of justice and fairness. The UEFA EURO 2024 commenced some days back. Yesterday, there was #turkiye Vs #Georgia, and Arda Guler, a young #turkish who plays for Real Madrid C.F., dazzled. It was his first-ever UEFA EURO appearance. But that wasn't what got my attention. What got my attention was a post on UEFA EURO 2024's verified Facebook page about Arda Guler. They used "A" for the word "Euro" rather than "AN." Here's why: "A" and "AN." What you should know: * A: When the first sound in a word is a consonant (a consonant sound begins the word), the article "a" is used. Example: A lion. In "Euro (ˈjʊərəʊ/)" the first sound is /j/ (the sound letter y usually takes), a consonant sound. It takes "a." A Euro debut. * AN: When the first sound in a word is a vowel (a vowel sound begins the word), the article "an" is used. Example: An elephant. NOTE: In determining whether to use "a" or "an," attention is paid to "sounds," not "letters." This means that the word has to be pronounced because some words begin with consonant letters but have vowel sounds as their first sounds, and vice versa. #English #englishlearning

Happy to share my latest article on match-fixing in individual sports, with a focus on badminton and tennis (although similar principles apply universally) published in the San Diego International Law Journal. The article takes a basic law and economics approach in order to show at what global rank athletes in these two sports break even in terms of cost and earnings. It goes on to show the increased risk of match-fixing for those athletes whose costs are higher than their earnings, particularly where their games are bettable. The International Tennis Integrity Agency (ITIA) has published updated rules for 2024, which apply across its Anti-Corruption Programme (TACP) and Anti-Doping Programme (TADP). As well as updates to reflect the prohibition of tramadol in-competition, there are refinements to key definitions and practices such as courtsiding which players and other persons involved in the sport will need to be aware of. One month has passed since the CJEU's judgements in the European Super League, International Skating Union and Royal Antwerp cases.
