Reflecting on an insightful experience at the London International Disputes Week! I had the privilege of attending a captivating panel discussion on "𝐅𝐢𝐠𝐡𝐭𝐢𝐧𝐠 𝐚𝐧 𝐀𝐫𝐛𝐢𝐭𝐫𝐚𝐭𝐢𝐨𝐧: 𝐎𝐩𝐭𝐢𝐦𝐢𝐬𝐢𝐧𝐠 𝐘𝐨𝐮𝐫 𝐂𝐡𝐚𝐧𝐜𝐞𝐬 𝐨𝐟 𝐒𝐮𝐜𝐜𝐞𝐬𝐬" co-hosted by Travers Smith and Essex Court Chambers. The event featured leading experts-Huw Jenkin, Adam Short, Emily Wood KC, David Walsh and Peter Webster, who shared strategies, war stories, and best practices for navigating arbitration proceedings. Key takeaways for me included: i. Critical and active management of arbitration: The panel emphasised the importance of proactive case management, from setting clear objectives to continuously monitoring progress. Staying ahead and anticipating potential obstacles is crucial for achieving a favourable outcome. ii. Early/ summary determination issues: The panel delved into the complexities surrounding early or summary determinations. Relying on the statistical analysis, the speakers provided valuable strategies on when and how to pursue these options effectively to save time and resources. The discussion also briefly addressed the due process paranoia plaguing the arbitration process, and also the transformative role of technology in modern arbitration. The session underscored that success in arbitration is not just about knowing the law but also mastering the art of strategy, management, and the adept use of resources and technology. A big thank you to the organisers and speakers for an enriching and thought-provoking discussion. A shout out to HKIAC on this #iwd2024 for their efforts to improve the diversity of arbitrators appointed by HKIAC! HKIAC 2023 statistics published this week reveal that of the 172 arbitrator appointments made by HKIAC, 60 (34.9%) were of female arbitrators, significantly higher than 2021 and 2022, 21.8% and 27% respectively. Further reflecting the increasing diversity of HKIAC arbitrator appointments, 59 (34.3%) were of arbitrators not previously appointed by HKIAC over the last three years. In terms of party and co-arbitrator designations of arbitrator confirmed by HKIAC, 12.8% and 19.2% respectively were female. #Arb-Wed-Arb: Does perfection come in threes? 🤔 One of the standout moments of this year's #LIDW24 was the keynote address of The Rt Hon. the Baroness Carr of Walton-on-the-Hill, Lady Chief Justice of England and Wales. The address was rich with ideas, including the suggestion that London's arbitral institutions, courts, and mediation providers could come together, learn from each other, and consider how they may complement each other, in order to best serve their users, thrive in the face of challenges, and take advantage of opportunities. A future "London Dispute Resolution Committee", as Lady Carr offered. 💡 This really resonated with me. When advising clients on how to provide for the resolution of their (potential) future disputes, while international arbitration will often be the most appropriate form of dispute resolution, mediation (and other forms of ADR or negotiated DR) often have a role to play, whether provided for contractually in advance, or kept firmly in mind for use at an appropriate moment. How different forms of dispute resolution relate and interact with each other in the context of a case can, however, be tricky to navigate. 🌍 I'm excited to see where the Lady Chief Justice's suggestion of greater, formal collaboration may lead the DR community in London and beyond.
