Construction Professionals: An award of attorneys' fees and costs is not a given in construction disputes. Once you are in litigation (arbitration or court) there are often times enough claims going back and forth that fees/costs claims are a wash. Of course, it happens. Go into disputes with tempered expectations on the recovery of attorneys' fees and costs.
