My latest paper, with co-authors, is now on SSRN. Using a newly developed dataset of all federal civil filings between 2016-2017 we show that in 60% of cases there were no dispositive motions filed, another 10% exit the system, leaving only 30% of cases with a dispositive motion filed. We explore some explanations for why this might be, and consider what it means for theories of civil litigation. Understanding Order 7 Rule 11: When Can You File for Rejection of Plaint? Order 7 Rule 11 of the Code of Civil Procedure, 1908, is a crucial tool in civil litigation. It allows the defendant to file an application for rejection of the plaint at various stages of a civil suit. A client recently asked, "At what stages can we file this application?" The answer is straightforward: an application under Order 7 Rule 11 can be filed at any stage of the suit, even before the framing of issues or during the trial. The key grounds for such an application include: 1. Failure to disclose a cause of action:- The plaint must clearly indicate a cause of action. 2. Suit barred by law:-If the suit is barred by any law, it can be rejected. 3. Underpayment or non-payment of court fees:- The plaint must be properly valued and the requisite court fees paid. 4. Plaint not filed in duplicate:- As required under Order 4 Rule 1 of the CPC. 5. Relief claimed undervalued:-If the relief claimed is undervalued and the plaintiff, despite the court's direction, fails to correct it.
