Tanisha Palvia, Member at Moore & Van Allen, advises and represents individuals and corporations facing white-collar criminal prosecution and government enforcement actions. She also manages and conducts internal investigations for various organizations, including financial institutions, private and public universities and schools, and medical providers, on a variety of sensitive issues, including financial fraud, Title IX, and labor and employment concerns. Her significant trial experience makes her a passionate advocate for her clients, both in the courtroom and out. Tanisha has always been devoted to pro bono work and represents indigent defendants charged with federal criminal offenses as well as victims of sexual assault in the prison system and human trafficking. Previously, she was a partner at a North Carolina firm and spent five years as a prosecutor in the Manhattan District Attorney’s Office in New York City where she prosecuted and tried a variety of criminal cases, including financial, sexual, and violent crimes. At the DA’s Office, Tanisha was chosen to lead the newly created Animal Cruelty Unit, tasking her with handling heinous crimes against animals, as well as supervising other attorneys handling those matters. She received her undergraduate degree from the University of North Carolina at Chapel Hill, where she was a Robertson Scholar, and she graduated from Emory Law School with honors. Immediately after law school, she was a law clerk for the Honorable Robert N. Hunter, Jr. at the North Carolina Court of Appeals. Did you ever wonder if you could sue the cops for shooting your dog? Today, in a case of first impression, the 11th Circuit answered "yes," and held that shooting a domestic animal constitutes a seizure of the owner's property -- subjecting the police officer's actions to the Fourth Amendment reasonableness requirement for purposes of a civil rights claim under 42 U.S.C. § 1983: "Sylvan Plowright sued Miami-Dade County, its police chief, and two of its police officers after one of those officers, Sergio Cordova, fatally shot Plowright’s dog, Niles, at the scene of an investigation. The district court dismissed Plowright’s complaint, concluding among other things that Cordova was entitled to qualified immunity because he did not violate any clearly established right when he shot Niles. We disagree. Addressing a matter of first impression in this Circuit, we hold that the use of deadly force against a domestic animal constitutes a seizure of its owner’s property subject to the Fourth Amendment’s reasonableness requirement. Because, under the facts alleged in the complaint, no reasonable officer in Cordova’s position could have believed that Niles posed an imminent danger, his decision to shoot Niles falls short of that requirement. ... this is one of the rare cases in which the unconstitutional nature of Cordova’s actions was clearly established to the point of obvious clarity, even in the absence of directly-on-point caselaw."
