Despite an employer's decision to use safety harnesses over guardrails for a high platform, a safety violation was issued, emphasizing a clear legal standpoint. Key Insight: OHS law mandates guardrails for any platform over 1.2 meters high, regardless of other fall protection measures. This scenario, derived from an Occupational Health and Safety Tribunal Canada decision, underscores the non-negotiable aspects of workplace safety laws. 🔗 Dive deeper into the case and its implications for workplace safety here. 🚨 OHSA Penalties Possible Without Workplace Accident 🚨 Non-compliance with the Occupational Health and Safety Act (OHSA) in Ontario can lead to significant penalties, even without any workplace accidents. This was recently highlighted in the case of THS Industries Ltd., a steel nail manufacturer in Kitchener, Ontario. In early 2023, THS Industries Ltd. and its CEO were fined a total of $100,000 for machine guarding violations. Ministry inspectors found numerous safety deficiencies, including removed fixed guards and workers bypassing safety devices on nail-making machines. Despite no injuries occurring, the Ministry identified a serious risk of injury, leading to the hefty fines. Key Lesson: Employers must prioritize compliance with OHSA regulations to avoid severe penalties and ensure the safety of their employees. Directors and officers can be held personally liable for corporate non-compliance. 👉 Read the full article here to learn more about this case and the importance of strict adherence to safety regulations. https://lnkd.in/eRCME9xb #OHSInsider #WorkplaceSafety #OHSA #HealthAndSafety #Compliance #SafetyFirst #EmployeeSafety #LegalUpdate #OccupationalSafety
