It's been a fairly taxing week to be honest. Any week that starts with a colonoscopy, routine or otherwise, generally falls into that category. The fact that this turned out not to be the most deeply unpalatable event of the past 5 days is probably sufficient to communicate the week we've had. The result was clear, for which I am beyond grateful. More personal background to this in the video if you're interested. The big positive of the week was a meeting with a managing agent who 'gets it' in a way that the majority of managing agents do not. I was unsurprised to learn that there was much I didn't know, but we had a very wide ranging conversation and I think we both learnt at lot from each other. There is little doubt that one of the biggest pains for conveyancing solicitors - and by extension home owners when they understand the problem - is the extremely mixed standard of management operations in developments across Northern Ireland. Sometimes the rot sets in right at the outset because the development hasn't been set up properly, and it's a slow moving car crash from then on. In other developments, the legal formalities have been set up correctly, but management operations have veered off course throughout the years, occasionally over a cliff edge. It was extremely useful to talk through both types of omnishambles (I'm being polite today) from the decent managing agent's perspective, and muse on potential solutions (not easy). There is little doubt that regulation of managing agents may assist in the long term, but I think the two biggest problems are (1) the legal formalities for proper management operations are either non-existent or fail, and (2) most apartment owners (in particular) seem to understand very little about the rights and responsibilities of living in very close proximity to others. With the latter, I fear that solicitors are not universally sitting their clients down and going through the Lease in detail. Perhaps you get what you pay for? It was a great conversation and I'm hoping for an early follow up. Unlike the colonoscopy, where I'm hoping for a follow up in not less than 5 years.
