Prevent litigation of workers compensation.... The key to preventing workers compensation litigation really comes down to communication. Frequent, clear, and in-depth communication of the process, status, and intent of the exclusive remedy is a sure-fire way to reduce WC litigation. My colleague, Debbie Hammer, MS, ARM explores the factors contributing to attorney involvement in claims and discusses proactive steps to curb this trend. #workerscompensation

📢 𝐆𝐄𝐈𝐂𝐎’𝐬 𝐌𝐮𝐥𝐭𝐢-𝐌𝐢𝐥𝐥𝐢𝐨𝐧 𝐃𝐨𝐥𝐥𝐚𝐫 𝐒𝐞𝐭𝐭𝐥𝐞𝐦𝐞𝐧𝐭𝐬! As your trusted insurance recruiter, I like to keep you abreast of all things insurance. Here’s the latest scoop: 🚗 GEICO’s Legal Battles 🚗 GEICO is set to pay around $8 million in two separate settlements involving auto claims adjusters and policyholders. 1️⃣ Auto Claims Adjusters: GEICO will pay $6 million to settle wage and hour law violations in Maryland and New York. The complaints alleged that overtime hours were not logged on time cards, though GEICO refuted these claims. 2️⃣ Policyholders: In New Jersey, policyholders will receive a $1.9 million settlement for claims that GEICO failed to pay title or registration transfer fees upon the total loss of insured vehicles. This follows a $48 million settlement by Progressive Insurance with New York drivers for allegedly undervaluing total loss claims. And let’s not forget, GEICO also recently settled a case involving former WWE star Tammy Lynn Sytch, AKA 'Sunny,' marking another chapter in the company's legal saga. 🗞️ Why This Matters: 1️⃣ For Employees: Staying aware of these developments helps you understand the industry's legal landscape. 2️⃣ For Policyholders: Know your rights and ensure your insurer treats you fairly. 3️⃣ For Job Seekers: Insight into these issues can help you ask the right questions during interviews. 📢 Stay tuned for more updates and industry insights! #InsuranceNews #GEICO #LegalSettlements #InsuranceRecruiter #StayInformed #Policyholders #AutoClaims #InsuranceIndustry #EmployeeRights

Strategies to control risk and mitigate claims work! The hard part for companies is getting these programs in place.
President ➤ Milestone Risk Management | Workers' Comp Strategies for Middle-Market Businesses | ExMod Management 📉 | Safety & Claims Processes that Work! | Board Member ➤ The Priority Center
How we cut premiums by 50% for this client 👇 A leading aftermarket auto part manufacturer faced a critical issue: A high Experience Modification (ExMod) rate due to poor communication between the employer and claimants. And an underutilized return-to-work program. This resulted in extended claim durations and costs. Doubling indemnity payments. And a spike in litigated claims as employees felt neglected. Here’s what we found when we ran our analysis 👇 1️⃣HR lacked awareness of claimants' medical appointments, missing opportunities to express care and keep tabs on recovery progress, leading to prolonged and costlier claims. 2️⃣Only half of the claimants received light/modified duty assignments, though nearly all could have been accommodated, unnecessarily inflating claim costs. 3️⃣Poor communication and support led to an environment where employees felt uncared for, significantly increasing the likelihood of litigation. Here’s what we did for them 👇 👍We established a new standard, ensuring all claimants received a personal note from HR within two days of injury, emphasizing the company's commitment to their recovery and navigation through the workers' comp system. 👍Our on-staff claims adjuster ensured HR was informed of all doctor appointments, facilitating better communication with employees and reducing missed appointments. 👍 We developed light/modified duty job descriptions, enabling nearly all injured employees to remain at work, significantly reducing the need for indemnity payments. The outcome? ✅The time from injury to full recovery shortened, and litigated claims became rare. ✅The manufacturer's ExMod rating plummeted from 220 to 77 within three years. ✅ Annual premiums were cut from nearly $500k to under $250k.
