I agree with Lee Curtis on this one. When someone seeks to cancel your EU trademark registration, it is more important than ever to submit extensive evidence of use for all of the items in the registration as much as possible. I know several US brands that have been influenced by the early "Big Mac" decisions and have invested considerably in preparing and submitting evidence of use. The impact on brands is that defending a cancellation action is extremely costly in terms of budget and time, and this can be used strategically by petitioners in leveraging their position in disputes. Smart brands will document use of their most important marks in the EU on a rolling basis, just in case. No in house person wants to have to say their famous mark was cancelled (in whole or part) because insufficient evidence of use was submitted. #trademark #trademarks #eutm https://lnkd.in/eiwpHWKA

Do you know what topic is now the biggest headache for competition lawyers and their clients operating in Czechia?🤕 The answer has 3 letters – RPM. (R)esale (P)rice (M)aintenance is the fixing of resale fixed or minimum prices by manufacturers or brand owners, which is a vertical restraint prohibited by the EU and national competion law. The Czech Competition Authority has long had vertical agreements – in particular RPM – in its crosshairs. Recently, it has focused its enforcement of RPM bans on large multinational entities, imposing staggering fines 📈 💸 on companies such as electronics and pet food manufacturers that often exceed those levied by foreign competition watchdogs for the same conduct. Yet there is no indication that the competition authority intends to change its enforcement policy. This is despite the fact that it faces critic of paying too much attention to RPM at the expense of other offences that have a more serious impact on consumers. However, the situation could get tougher. The Czech Competition Authority already conducts frequent dawn raids during RPM investigations. 🔎 There are now serious debates about further expanding its powers, enabling the watchdog to conduct inspections without any suspicion of anticompetitive conduct. This poses a risk of legalising ‘fishing expeditions’ which could also occur during antitrust investigations related to distribution relationships. The good news is that the cure for this headache is effective compliance programs. 🗞 Ideally, a robust effective compliance program may provide protection against any trouble with the competition authority. However, even when it fails to prevent anticompetitive conduct, having a compliance program in place allows the companies under investigation to use it as a powerful argument in proceedings before the competition authority and achieve a significant reduction of the fine.
