In the last three Januarys, firms have prioritized hiring litigators. In 2022, 133 attorneys moved firms. Litigators were in the highest demand. In January 2023, the total decreased to 100. Litigation once again topped the new hire list. January 2024 nearly matched 2022 and significantly outpaced 2023. There were 129 attorney moves in California. Litigators were once again the hottest commodity as California firms added 63 litigators. IP hiring has been steady and Corporate hiring has picked up significantly in 2024. These trends make sense because litigation is a steady revenue stream for firms, even in down economies. In fact, many litigation groups are countercyclical (insurance, construction, L&E) and increase activity significantly in economic downturns, as firm clients look to capture unrealized financial assets of face suit from companies or individuals looking to do the same. In other words, litigators are never out of vogue. But, at the first sign of rate increases or as soon as people accept current rates as the new normal, I expect corporate deal flow to pick up. Once that happens, firms will realize their associate rosters are thin and will look to add talent.
