It’s been sixteen years since I became an attorney. Since then, I’ve discovered three major myths about employment law aren’t true: 1. A jury won’t understand a specific type of discrimination Jurors have backgrounds as managers, employees, or co-workers, which helps them relate to most claims. I’ve been pleasantly surprised by how well people recognize discrimination, regardless of form. 2. It’s all common sense It’s true that *some* aspects of employment law are straightforward, but the reality is far more complex. Laws vary by jurisdiction, and cases are more nuanced and layered than they initially seemed. 3. Companies triumph over individuals Sadly, this notion is still a belief: Judges and juries will believe a powerful company over an individual. My experience has taught me that the truth is encouraging. With the proper evidence and legal strategy, every voice can be heard in court. I’ve witnessed individuals achieve justice and compensation against even the most formidable corporate defendants. Justice doesn’t favor the powerful but rather the just.

Talking with HR professionals about the changes in the FLSA salary minimums is always a great time. Great questions from the audience including a response that confirmed that the FLSA regulations allow employers to use nondiscretionary bonuses and incentive payments (including commissions) paid on an annual or more frequent basis, to satisfy up to 10 percent of the standard salary level. Additionally, if after the 52-week period, the employer has not met its financial obligation, the employer can make a final “catch-up” payment within one pay period after the end of the 52-week period to bring an employee’s compensation up to the required level. Any such catch-up payment will count only toward the prior year’s salary amount and not toward the salary amount in the year in which it is paid. Don't let the FLSA changes scare you!
