Our founder and one of our trustees, Duncan Garvie, recently addressed the subject of fake games being distributed by black market gambling operators in an article published on CasinoReviews.com. This is a critical issue. The black market explicitly targets those impacted by gambling harms, and then deploys cheating software, disguised as reputable brands, to exaggerate those gambling harms by accelerating player losses. These games are being marketed to operators specifically emphasizing how they can be customised to cheat players. This could be as basic as reducing the RTP below that which the genuine game would function at. But it could just as easily be a lot more deceptive. Top payouts could be advertised, but simply not available to players. Win caps could be deployed, ensuring that if a player was ahead of the house, wins were restricted. Streamers could be provided with fake money games. Or provided with versions of the games that return at a far higher rate than the games players access. The black market is an existential threat to consumers and far more needs to be done to combat it. Fortunately, BetBlocker is just as effective at blocking black market operators as it is licensed ones.

GAMBLERS KNOW THE HOUSE ALWAYS WINS! (well they do now!) WITH ODDS LIKE THESE . . . Mrs P-G won £10 from Camelot in an instant win online game. All she had to do was match her number with a set of random numbers. A win is signalled by both numbers being highlighted with flashing lights. This is set out before you play. No highlight no win. Mrs P-G won £10 but saw that she also matched a 2nd set of numbers and they were shown on the screen but not highlighted. The 2nd set meant a pay out of a further £1m in prize money. Or so she thought . . . THE CODING ERROR The numbers were on the screen alright but not highlighted, no flashing lights. A coding error showed the 2nd set of numbers but they weren’t highlighted as this was an error. Camelot refused to pay and Mrs P-G sued. JOAN PARKER-GRENNAN V CAMELOT UK LOTTERIES LTD [2023] As a reason not to pay, Camelot relied on a Term that said they could invalidate a game and not pay out if the outcome displayed was “inconsistent with the result that was PREDETERMINED” . . . by their computer system. Mrs P-G claimed this Term was: 1 Not incorporated ie did not form part of the contract, or 2 If it was incorporated was an unfair term (the Unfair Terms in Consumer Contracts Regulations 1999 (UTCCR), or 3 If it wasn’t unfair then on a proper construction its interpretation was ambiguous and so couldn’t be relied on by Camelot. AND THE WINNER IS . . . . . . Camelot. 1 It was held that as Mrs P-G had the chance to read the Terms and ticked a box accepting the Terms, then the Term was duly incorporated. 2 In the nature of a gambling contract being able to invalidate a win due to a software error was reasonable and to be expected. Furthermore, whilst it is established law that onerous or unusual terms must be highlighted at the outset to be binding, in the nature of this contract (chance) the Term was neither unusual nor onerous and did not have to be highlighted. So the Term was not unreasonable. 3 Lastly due to the nature of this contract (chance) a proper interpretation was that if the numbers did not flash on the screen then there was no win. This was clearly stated on the screen before play. Any reasonable player would have understood this. WHAT HAVE WE JUST WON This case is a reminder of just how important it is to have a proper set of bespoke T’s & C’s properly incorporated in to your customer contracts whether with consumers or businesses. (Cut & paste is high risk.) Make sure they are written in plain English so as to be understandable and not hidden away or in such small print they are unreadable.
