On July 1, 2024, newly enacted privacy laws in Texas and Oregon will come into effect. The new consumer data protection measures, along with authorized agent provisions, will enhance the control residents have over their personal data, aligning with the trend of increasing state-level privacy legislation across the U.S. Texas and Oregon have become the tenth and eleventh states, respectively, to enact general privacy legislation, following California, Virginia, Colorado, Connecticut, Utah, Iowa, Indiana, Tennessee, and Montana. Like the groundbreaking privacy laws in California and those of other states, the Texas and Oregon laws will improve consumer privacy and security nationwide as more businesses move to comply with these regulations. Texas AG Launches Data Privacy Team. In addition to the Data Privacy and Security Act, the newly created team will enforce other privacy-related laws, including #COPPA and #HIPAA. As I dig deeper into my degree I start learning and discovering so many things I never thought I would look at. Part of this was the law pasted below. I did not know Colorado had privacy laws like this. The most fascinating thing I find is the definition of consent. (5) "CONSENT" MEANS A CLEAR, AFFIRMATIVE ACT SIGNIFYING A CONSUMER'S FREELY GIVEN, SPECIFIC, INFORMED, AND UNAMBIGUOUS AGREEMENT, SUCH AS BY A WRITTEN STATEMENT, INCLUDING BY ELECTRONIC MEANS, OR OTHER CLEAR, AFFIRMATIVE ACTION BY WHICH THE CONSUMER SIGNIFIES AGREEMENT TO THE PROCESSING OF PERSONAL DATA. New: I honed in on one important component of the American Privacy Rights Act discussion draft bill: the way it handles the largest, most-prolific purveyors of Americans' personal data. In its current form, the legislation would bring some much needed sunlight to an otherwise shady industry, forcing data brokers to identify themselves and their business model prominently on their websites, offer clear opt-out options for data collection and create a national registry to help policymakers and the public better track the industry. I attended the IAB Policy event and IAPP - International Association of Privacy Professionals event this week in Washington. ENFORCEMENT IS NOW Enforcement of the law is underway and there is no longer a 30-day right-to-cure period. Macko is serious as he said it at both events and everyone will be back Monday from the event scheduling a meeting to discuss.
