Legal requirements for marketing email can vary country by country. In some countries, you are required to get consent before sending marketing emails, and in other countries consent is not required. However, in nearly every country, the one thing you do need to include in your marketing email is a functional unsubscribe mechanism, allowing recipients to opt out of receiving additional marketing emails from your organization in the future. Whatever unsubscribe mechanism you choose, test it periodically to make sure it works, and make sure to opt out recipients promptly (within 10 days of receiving an opt out request). You've been SCAMMED. By every tool you relied on for sending emails. Many of these tools parade around as if your emails are getting delivered. When it's impossible for them to actually tell you this. Now, most of the tools aren't scamming you intentionally. But some are. And it's a shame. Some of them tell you that Open Rates are your guiding metric. WRONG. Then some tell you that you're getting good delivery by using a dumb calculation. Sends - Bounces = Primary Inbox WRONG. Before sending any text messages, you should make sure your program meets legal and regulatory compliance standards. At a high level, SMS marketing compliance requirements in the US include the following: Your subscriber must explicitly opt-in for SMS marketing in writing. This opt-in has to be a separate from email marketing. You must clearly explain to potential subscribers what types of messages they’ll receive and how to opt out. You must respect opt-out requests. You can’t send text messages during federal- and state-specific “quiet hours." The absence of a formal strategy suggests that many brands could be missing out on the benefits of SMS marketing, such as: High engagement rates: SMS messages have been known to have higher open rates than other digital communication forms. Regulations governing commercial email vary widely country by country. In the US, you can send marketing emails to US residents without obtaining permission from the recipient, as long as you provide a mechanism allowing the recipient to unsubscribe from receiving emails in the future. In the EU, you need to obtain affirmative consent before sending marketing emails. Some other countries take the US "opt out" approach, and others have adopted the EU "opt in" method. Given that the rules vary based on the location of the recipient, you should factor consent requirements into your marketing strategies. Noncompliance can not only get you into trouble from a regulatory perspective, but can also negatively impact your customer relationships.
