🚨 Safety Alert: Protecting Workers in Rollovers! 🚨 Many workplaces rely on powered mobile equipment like forklifts and backhoes, which can be dangerous if not used properly. For example, equipment operators can accidentally run over unaware workers or, in some cases, the equipment itself can tip or roll over, endangering the operator. 🚧👷♂️ A recent incident in BC serves as a stark reminder of these dangers. A mobile vibratory soil compactor slid down an embankment, rolling over several times and seriously injuring its operator. The investigation identified unsafe equipment use, choosing the wrong equipment for the task, and inadequate instruction as contributing factors to the incident. To protect workers in rollovers, employers should consider two key tips: 1. Install Rollover Protective Structures (ROPS): ROPS are essential for protecting operators during rollovers. If your mobile equipment requires ROPS under OHS regulations or if a hazard assessment identifies rollover as a potential hazard, installing ROPS is crucial. Compactors are often on the list of equipment requiring ROPS. 2. Provide and Require Seatbelt Use: OHS regulations mandate that powered mobile equipment be fitted with seatbelts. Seatbelts prevent operators from being thrown from the equipment and possibly crushed in the event of a rollover. If wearing a seatbelt is impractical for certain equipment or job types, provide alternative safety measures such as shoulder straps, gates, or screens. 🚨 OHSA Penalties Possible Without Workplace Accident 🚨 Non-compliance with the Occupational Health and Safety Act (OHSA) in Ontario can lead to significant penalties, even without any workplace accidents. This was recently highlighted in the case of THS Industries Ltd., a steel nail manufacturer in Kitchener, Ontario. In early 2023, THS Industries Ltd. and its CEO were fined a total of $100,000 for machine guarding violations. Ministry inspectors found numerous safety deficiencies, including removed fixed guards and workers bypassing safety devices on nail-making machines. Despite no injuries occurring, the Ministry identified a serious risk of injury, leading to the hefty fines. Key Lesson: Employers must prioritize compliance with OHSA regulations to avoid severe penalties and ensure the safety of their employees. 📢 Eastway Tank: A Stark Reminder for Officers and Directors On April 5, 2024, Eastway Tank, Pump & Meter Limited and its owner and director, Neil Greene, pled guilty to charges under Ontario’s Occupational Health and Safety Act (OHSA) due to a tragic explosion at their Ottawa facility on January 13, 2022. This incident, one of the worst workplace accidents in Ontario in the last 50 years, resulted in six deaths and severe injuries to a seventh worker. The fines imposed are among the highest ever for a small corporation and an individual director under the OHSA. 🔍 Key Points: - The explosion was caused by gasoline contamination during a diesel fuel test. - Eastway and Greene were fined $850,000 in total, including a $600,000 fine for the company and $80,000 for Greene. - This case underscores the serious consequences of failing to comply with the OHSA. 🚨 Takeaway for Officers and Directors: - Corporate directors and officers must ensure compliance with the OHSA. - Failure to comply can result in severe legal and financial consequences. - Directors and officers must demonstrate the steps they took to meet their obligations under the OHSA.
