In May 2024, the Council of Europe adopted the first-of-its-kind legally binding international AI framework, “Council of Europe Framework Convention on Artificial Intelligence and Human Rights, Democracy, and the Rule of Law.” This is a common legal framework open for adoption at the global level and requires the signatories to adopt or maintain appropriate domestic legislative, administrative, or other measures to ensure that activities within the lifecycle of AI systems are fully consistent with human rights, democracy, and the rule of law. This Client Alert summarizes the robust multistakeholder negotiation process behind the Framework Convention along with its key principles for adoption by signatories. The Framework Convention on Artificial Intelligence, Human Rights, Democracy and the Rule of Law has been finalised this week by the Council of Europe Committee on Artificial Intelligence. The draft text will be referred to the Committee of Ministers for adoption and opened for signature at a later stage. Our focus has been having a meaningful instrument which is compatibe with the EU AI Act whilst securing global reach. The final draft puts an obligation on all future parties to address the risks posed by activities within the lifecycle of AI by public and private actors, while taking into account the respective roles and responsibilities of all stakeholders. It gives flexibility to parties in meeting the agreed obligations according to their domestic legal and institutional frameworks. The convention will also provide for new opportunities for cooperation with states that will not yet have ratified it – which will contribute to its potential to have a global reach. Proud to have been part of the core EU negotiating team for this landmark UN General Assembly resolution on #artificialintelligence. The resolution was adopted by all 193 Member States by consensus and formulates key principles for and approaches to the application of safe, secure and trustworthy AI in support of #sustainabledevelopment. Negotiations stretched over two months and with more than 40 hours of informal consulations, the process contributed to building relationships and mutual understanding among diplomats. Today a swathe of countries including the U.S., the U.K. and the European Union signed up to a treaty on #AIsafety laid out by the Council of Europe, an international standards and human rights organization. The Council of Europe Framework Convention on #ArtificialIntelligence and Human Rights, Democracy, and the Rule of Law — as the treaty is formally called — is described by the COE as “the first-ever international legally binding treaty aimed at ensuring that the use of AI systems is fully consistent with human rights, democracy and the rule of law.” Artificial intelligence regulation has been a hot potato in the world of technology, tossed among a complicated matrix of stakeholders. “The treaty will ensure countries monitor its development and ensure any technology is managed within strict parameters,” the U.K. Ministry of Justice noted in a statement on the signing of the treaty. “Once the treaty is ratified and brought into effect in the U.K., existing laws and measures will be enhanced.” https://lnkd.in/esAJtaHn

📢 CAIDP Participates in Negotiation for Global AI Treaty This week CAIDP Global Program Director Karine Caunes is in Strasbourg to participate in the ninth plenary session of the Committee on AI of the Council of Europe. The aim is to finalize the drafting of the Council of Europe Treaty on AI, the first global treaty for the governance of Artificial Intelligence. The Committee is expected to complete the work by 14 March 2024. The Council of Europe's mandate is to protect fundamental rights, promote the rule of law, and safeguard democratic institutions. Work on the draft AI treaty began in 2019. Joining with many Civil Society Organizations, the Center for AI and Digital Policy has focused on three key points: 1️⃣ Ensure a broad and comprehensive treaty that covers AI systems in both the private sector and the public sector. 2️⃣ Opposes exemptions for "national defense" and "national security" that are prone to abuse and misuse 3️⃣ Ensure an effective implementation plan that includes ongoing oversight and coordination CAIDP, other Civil Society Organizations, and many national delegations have also expressed concerns about non-Member states that are seeking to diminish the scope and impact of the treaty. 🌐 **Renew Conference on AI Competition** On February 19, the Renew Europe Group hosted a conference dedicated to competition issues in the field of artificial intelligence. At the invitation of Stéphanie Yon Courtin, this event brought together various speakers to discuss the challenges related to AI in terms of competition and market restriction. **Overview of the Issues** Karen Melchior, fictitious rapporteur for the Renew Group on artificial intelligence in the JURI committee, emphasized the importance and sui generis nature of this legislation. As the world's first regulation on AI, it is time to address the issue of major corporate monopolies. Stéphanie Yon Courtin also stressed the importance of AI benefiting everyone, ensuring it is not a technology in the hands of a few companies, "a monopoly, and preventing other companies from using it." Thus, it is necessary to strengthen the anti-trust dimension to prevent the dominance of large tech companies. Strategic investments and partnerships raise concerns about the risk of reinforcing the position of the GAFAM. In the annual competition report, for which French MEP Stéphanie Yon-Courtin is rapporteur, Parliament called for the use of the Digital Services Act legislation to address these issues. Margrethe Vestager stated that it was essential to "shine a spotlight on AI and competition to shape emerging markets and ensure that competition can thrive, a greater engine of innovation, allowing consumers to enjoy affordable prices. These markets must develop in accordance with our values and rules." According to her, the EU must also equip itself with a resilient framework to deal with foreign interference. In this regard, the Commission will soon unveil a communication on its defense strategy. The goal is to develop a common security potential to control external investments, predatory operations in order to avoid the loss of European technologies. Internationally, the European Union continues to strive to use its normative power with the CCT, whose next ministerial meeting will be held in April.
