I'm doing it, and I invite everyone to do it too. "We were previously in touch for the XYZ requisition" (We most certainly were not. your solicitation emails are not us "being in touch") No indication it's a commercial email. No opt out. We're rock solid on who our partners are - but this is written in such a way many people would be duped by it. There are specific requirements for email solicitations to be in compliance: 1) Don’t use false or misleading header information. Your “From,” “To,” “Reply-To,” and routing information – including the originating domain name and email address – must be accurate and identify the person or business who initiated the message. 2) Don’t use deceptive subject lines. The subject line must accurately reflect the content of the message. 3) Identify the message as an ad. The law gives you a lot of leeway in how to do this, but you must disclose clearly and conspicuously that your message is an advertisement. 4) Tell recipients where you’re located. Your message must include your valid physical postal address. 5) Tell recipients how to opt out of receiving future marketing email from you. Your message must include a clear and conspicuous explanation of how the recipient can opt out of getting marketing email from you in the future. Craft the notice in a way that’s easy for an ordinary person to recognize, read, and understand. 6) Remember that subscribers and members can opt out of marketing emails, too. Recipients of emails from a sender that runs a subscription service or membership program still have the right to opt out of marketing messages from you. 7) Honor opt-out requests promptly. Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your message. You must honor a recipient’s opt-out request within 10 business days. You can’t charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website as a condition for honoring an opt-out request. Once people have told you they don’t want to receive more messages from you, you can’t sell or transfer their email addresses, even in the form of a mailing list. 8) Monitor what others are doing on your behalf. The law makes clear that even if you hire another company to handle your email marketing, you can’t contract away your legal responsibility to comply with the law.

And now for something completely different - runaway social media fraud. After receiving so many similar messages I thought it worth sharing the attached sample of a common LinkedIn scam along with my thoughts. This is job solicitation of a type I receive so often I have come to conclude that LinkedIn doesn't want to flag this as a scam or spam because it's a paid message. It is from an ersatz CVC Capital HR employee who asks for my phone number to speak about an exciting opportunity with his boss. His profile links to the real CVC Capital Partners LinkedIn page to give it an air of legitimacy. CVC seems to be the company of choice for this scam. My humble apologies to dearest Javier and CVC on the remote chance this is legit (sarcasm intended). CVC may be a bit upset that their profile is so popularly used in this scam. The telltale signs in this message are so obvious that email filters circa 1999 would flag this. LinkedIn may not want to flag it because it could dramatically reduce their paid traffic. You can read Javier's message (who sadly but not surprisingly has one contact - another tell). You can also see my reply. Not shown here is Javier's reply. Which follows the predicted pattern. This isn't just a LinkedIn issue, it's a virus across all social media including YouTube, dating apps, etc. One scammer comment on youtube could trigger dozens of follow on scam comments (much like the fake crowd at a shell game who "win" thus encouraging ordinary shills to play). The poster of the video may be very legit but they don't want to remove the comment as it would hurt their engagement metrics and ad dollars. Why should you care? 1) You or your family may fall for such a scam, 2) you may buy social media ads that are pumped by fake traffic, 3) the valuations of the hottest part of the stock market may be wildly inflated owing to fake or scam traffic. None of this may be surprising. What may be surprising is that the companies know full well but fail to stop it as it has become a critical part of their business model. It isn't flaw, but a feature. What the traffic be of social media if he FCC applied the same spam rules to social media traffic as they apply to email. #socialmedia #socialmediamarketing
