Fort Lauderdale East Partner Craig Minko and Associate Nat Morales recently obtained an extraordinary victory for a South Florida community association. The case involved a tenant of a unit owner suing the community association for a breach of a lease agreement with his landlord and violations of Chapter 83, Florida Statutes. Our team filed a Motion for Judgment on the Pleadings on the basis that the community association was not the tenant's "landlord", and was otherwise not party to the lease agreement. The Court ultimately granted the Motion for Judgment on the Pleadings, entering full and final judgment in our client's favor. This ruling establishes a critical legal distinction, clarifying that, under the current language of Chapter 83, community associations cannot be considered the "landlord" of tenants renting from the unit owners, and that lease agreements between unit owners and their tenants do not incorporate community associations as parties to the agreements. This precedent should certainly have a positive and lasting impact on community associations throughout South Florida. Every action we take sends out ripples far and wide. This is especially true in our professional roles where what we do has far reaching influence and consequence for people's lives. Yesterday I co-hosted a rental home quality event with Rebecca Pinkstone as a joint initiative of NSW Fair Trading and Homes NSW. Over 310 people registered with representatives from across government and the tenancy support and housing delivery sectors attending. The event welcomed award winning author, journalist and contributing editor to Inside Housing, Peter Apps to discuss his forensic analysis and deeply human reporting on the Grenfell tragedy. It delivered critical lessons for all involved in the delivery and maintenance of safe quality rental homes in NSW. #DidYouKnow that in 1980, Bet Tzedek filed a class action lawsuit aimed at overturning scores of approved condominium conversions? The lawsuit claimed that West Hollywood tenants did not receive adequate notice of the planned conversion of their apartment buildings. This lawsuit, which allowed Bet Tzedek to support dozens of vulnerable tenants at once, was an important milestone in our early work upholding housing justice and creating city-wide equity. Today, our Eviction Defense Program is an important part of Stay Housed L.A., a partnership between Los Angeles County, the City of Los Angeles, and local community and legal service providers that works to keep people in their homes. Though The Commercial Dispatch headline is hard to argue with, there is more to the story. Getting the right "stick" on "the books" is a great first step, but to ensure more frequent and accelerated actions, additional resources need to me made available. With the rare exception, funding and training for code enforcement has not been the priority at State Legislatures. In the interim, more focus should be given to a) ensure code enforcement is utilizing all available resources, internally and externally, and; b) updating local ordinances and; c) ensuring policies and procedures (and their respective resources) are created, implemented and utilized with proactivity, efficiency and logic. On the last point, the article discusses "properties which don’t need much attention" but even "simple" grass/weed cutting can add up, especially with limited funding and staffing. If there were ways to get others to do it shouldn't they be utilized?
