Policy Alert: Treasury Rule Will Clarify Tax Status of Tribally Chartered Corporations Yesterday, the Department of the Treasury and Internal Revenue Service (IRS) announced important rule language that will clarify Tribally Chartered Corporations have the same tax status as the owning Tribe. The notice of proposed rulemaking addressed longstanding issues regarding the tax status of tribally chartered entities. This proposed rule recognizes that wholly owned tribal entities chartered or organized by one or more Tribes have the tax status of their owning tribes. This means business entities entirely owned by a Tribe will not be subject to federal income tax. In addition to the proposed rules, Treasury announced it will hold Tribal consultations on December 16th, 17th, and 18th.  Treasury will also be accepting written comments until January 7th, 2025.  If you are interested in submitting comments, please do so at [email protected]. https://lnkd.in/ep2nyPFa

Tribes can make their voices heard and submit comments on IHS’s (Indian Health Service’s) implementation of Becerra v San Carlos Apache. IHS will hold a consultation on Oct. 9th from 1 – 5 p.m. Eastern Time and written comments will be accepted through October 11th. Details of the consultation meetings were sent in a Dear Tribal Leader letter last month. Registration is required to attend. The Tribal CSC Advisory Group (Co-Chaired by President Martin Harvier of the Salt River Pima-Maricopa Indian Community) has provided tribal leaders with suggested talking points in response to IHS’s consultation questions.

Policy Alert: Upcoming IRS Webinars and Treasury Consultation The Internal Revenue Service (IRS) is hosting two identical webinars to discuss and review federal tax responsibilities for non-employee payments for tribes and tribal entities scheduled from 12 p.m. – 4 p.m. Eastern Time on November 6th and 13th. The webinars will cover basic information for accounts payable employees and those responsible for filing Forms 1099 and Form 945. Registration is required to attend.
