Yes, 140 years ago surveyors did not have GPS or 1 second total stations so they understood, by and large, the preeminence of monuments. Some didn’t, though, and there was a seminal case in Australia where the court overturned a clever survey that missed a 40 year old fence by 30 feet. I learned surveying in Sydney when we measured as best we could with a 300 foot “wire.” I remember calculating up a survey of an old rural portion marked at one corner by an old round 4-way fence post (ORP). My bosses instructed me to call that the corner regardless of discrepancies in measurements. I believe that is the sort of thing Justice Cooley had in mind. Quasi judicial functions implies extra judicial decisions made by professionals that will stand up in court if well documented and reasonable. Accountants understand the concept - they sign off on your taxes and the IRS will defer to them, so will the courts. You can’t have every boundary line be subject to a court fight. Someone has to bite the bullet and monument a line that makes sense on the ground. Who else but a surveyor is capable of fulfilling that quasi judicial function?

Chief Justice Thomas McIntyre Cooley (1824-1898) served on the Michigan Supreme as Chief Justice from 1864-1885. His lecture "The Judicial Function of Surveyors" was first presented to the Michigan Association of Surveyors and Civil Engineers in 1881. The word "Quasi" was inserted into the title several years later. By Cooley's own words, the lecture was centered around Public Land Surveying in Michigan, and as a result it seems to me that his advice must be looked at in that context. It also should be noted that Cooley used words or phrases such as "should,", "may," "ought," "frequent,", et. al instead of "must," "always,", etc. I believe that was intentional, since one of an attorney's "tools of the trade" are words. I believe Cooley's lecture should be in every surveyor's library; I also believe every surveyor should be careful not to insert their own opinion about what Cooley meant, and must understand its context. It was written 143 years ago when the subdivision of land in Michigan was relatively new. I have attached the first and last paragraphs of Cooley's lecture; they are important.
