OSHA published its final Worker Walkaround Representative Designation Process rule on March 29. The rule permits the employer to authorize non-employee representatives to accompany OSHA inspectors during workplace inspections. The representative must be reasonably necessary (i.e., needed for the inspection) based on the representative’s experience, knowledge, or skills. The new regulation is, in part, a response to a 2017 court ruling that OSHA’s current rule, 29 CFR 1903.8(c), only allowed employees to serve as representatives.
