We do not get to read many decisions from the AAT when a provider appeals a decision of the regulator, TEQSA. Here is one from late 2023. What is interesting is that there were 3 experts which a positive recommendation and the regulator sought a 4th expert, who was an outlier in saying no. It is obvious from reading the documents that the applicant had met the requirements to have their provider category changed to University College but the application was rejected based on the outlier's report. We are aware of a number of applications of various purposed where there has been an expert used by the Regulator who is an outlier and the multiple positive reports are ignored. Hopefully the issue of costs will get to the Federal Court so that providers who win these bleeding obvious cases can recover costs against the Regulator and the outlying expert(s). Beginning February 2024, ACT will have an online option at select locations in the US after a successful trial this past December. ACT expects to expand its online platform for the February, April, June, and July tests at limited locations, with the online option availability for all students by the Fall of 2024. ACT will continue to have the option for pencil and paper-based testing. Similar to the digital SAT, the online ACT requires test-takers to be at an official test center. However, unlike the SAT, online ACT participants cannot use personal devices.
