The Council of Ministers has rejected one of the most significant recommendations made by the TJ Expert Group—the establishment of a Special Court. According to the Reporter, the Council rejected the proposal to create a Special Court and instead approved the formation of a special chamber within the existing court structure.
This decision is regrettable, especially considering that the current judicial system lacks the popular trust and legitimacy needed to address accountability cases independently .

In recent times, there have been several troubling transgressions that call into question the sanctity of judicial independence. To safeguard this critical pillar of democracy, it is imperative that judges, upon taking office, be required to file an undertaking—similar to the existing restriction on practicing in the same court—barring them from contesting elections, accepting Rajya Sabha nominations, or assuming executive positions for at least five years post-retirement. These measures are vital to maintain the Judiciary’s impartiality. Furthermore, any public display of allegiance, whether through speeches or actions from the dais or the bench, towards political parties, organizations, or individuals, should be met with stringent breach-of-protocol action. Only then can we restore faith in an independent, unbiased judicial system.
