I believe that the proposed new Criminal Procedure Code in Egypt poses a significant threat to the entire judicial system. Legalizing warrantless searches, reducing the role of lawyers in defending their clients, and criminalizing trial monitoring are direct attacks on citizens' rights and dismantle the foundations of criminal justice. Passing such a law would represent a serious regression from the principles that uphold the rule of law and justice. This is a great and highly important piece on the draft Criminal Procedure Code in Egypt by Mai El-Sadany.
NEW: #Egypt is considering a new Criminal Procedure Code that, if passed, threatens to destroy the country's entire criminal justice system--normalizing warrantless searches, eating away at the role of lawyers in their clients’ defense, and criminalizing trial monitoring, among other alarming provisions. So what's in the law and why does this matter? Rape survivors speak out about treatment by criminal justice system Rape survivors have spoken out about their mistreatment by the criminal justice system, describing how they were treated as "outsiders" and "a bit of evidence". The women shared their experiences with the Criminal Justice Committee, highlighting the need for more support for complainants in rape cases. While some expressed concerns about proposed reforms, such as judge-only trials and reducing the number of jurors, they emphasised the importance of a survivor-centric justice system. One survivor stated, "I felt humiliated, I felt abused, I felt like I was treated like a criminal." The survivors called for change and emphasised the need for a more consistent and trauma-informed approach to justice. Their testimonies were given during the scrutiny of the Victims, Witnesses and Justice Reform (Scotland) Bill.
